                Center Organizer) in Sambasivapuram Panchayat Union Middle School,

                Sambasivapuram village, Walajah Taluk, Ranipet District with all consequential

                service benefits.

                                                                  ORDER

This Writ Petition has been filed challenging the order dated 19.09.2025 passed by the first respondent and the order dated 26.09.2025 passed by the second respondent, thereby terminated the petitioner from service.

2.Heard the learned counsel appearing on either side and perused the materials available on record.

3.The petitioner was appointed as a Noon Meal Organizer on 28.09.2017.

This Court, by an order dated 05.12.2024, set side the order of appointment order dated 28.09.2017 and directed the authorities to appoint the said Seetha as Noon Meal Organizer, on the ground that the post of Noon Meal Organizer in Sambasivapuram Panchayat Union Middle School, Sambaivapuram Village, Walajah Taluk, Ranipet District was reserved for Backward Class (Other than BC Muslims)/Destitute Widows (Non Priority). Out of 20 applicants, the petitioner wass the only candidate who fulfilled the reservation turn of Backward Class (Other than BC Muslims)/Destitute Widows (Non Priority). However, the counter affidavit stated that the petitioner is a resident of Kavarapalayam Village, which is five kilometers away from Sambasivapuram Panchayat Union Middle School.

4.As per G.O.Ms.No.163, Social Welfare and Nutrition Food Scheme (N.F.2) Department, dated 18.08.2010, the distance between the place of 3/7 https://www.mhc.tn.gov.in/judis ( Uploaded on: 09/12/2025 07:46:53 pm ) W.P.No.41727 of 2025 appointment and the applicant's residence should be within three kilometers.

Therefore, the petitioner failed to fulfill the residential criteria and her appointment was set aside. Pursuant to the order passed by this Court, the first respondent terminated the petitioner from service on 26.09.2025.

5.In view of the above, this Court finds no infirmity or illegality in the order of termination dated 19.09.2025 passed by the first respondent and the consequential order passed by the second respondent 26.09.2025. However, the petitioner filed a Writ Appeal as against the order passed in W.P.No.3511 of 2018, which is pending. If the petitioner succeeds the Writ Appeal, the order of termination shall stands automatically stand set aside.

6. In the result, this Writ Petition stands dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
