CORAM:
HON'BLE MS. JUSTICE REKHA PALLI
ORDER
% 01.06.2021 CM APPL. 17837/2021
1. Exemption allowed, subject to all just exceptions.
2. The notarized affidavit to be filed within two weeks of the Court resuming physical hearing.
3. The application stands disposed of.
CM APPL.17882/2021
4. This is an application filed by the petitioner seeking modification of the order dated 20.05.2021 to reflect that the respondent no.1 had, in its reply filed before the Court in these proceedings, undertaken to clear all applications received under Form FC-6C within a week. This form, newly prescribed by the Foreign Contribution (Regulation) Amendment Rules, 2020 contain an intimation from the applicant to the said respondent of its designated FCRA account in the SBI, New Delhi Main Branch, Sansad Marg and change of another, previously existing 'FCRA' account.
5. Learned counsel for the petitioner submits that even though the respondent no.1 had categorically stated before this Court that it would process all FC-6C applications received by within a week, this aspect was not recorded in the order dated 20.05.2021.
6. Mr. Apoorv Kurup, learned counsel appearing for the respondent no.1 submits that the affidavit containing this statement from respondent no.1 was filed in a connected petition, being W.P. (C) 5310/2021, and, therefore, this application ought to be preferred in that petition instead.
7. In my view, once the respondent no.1 has already taken a common stand before this Court in the batch of petitions that it would process the FC- 6C applications received by it as soon as possible and within a period of one week, there is absolutely no reason to direct the petitioner to move an application seeking the same relief in W.P. (C) 5310/2021
8. At this stage, learned counsel for the respondent no.1 prays for and is granted two days' time to obtain instructions.
9. At request, list on 03.06.2021.
