2. N.C.D.R.C, New Delhi "M/S. FIITJEE Ltd. & Anr. Versus Pramod Pareek"- Revision Petition no. 462/2013, Decided on 10-07-2020 The law is well settled as regards the scope of the revisional jurisdiction of this commission. This commission will not be justified in interfering with the order passed by the fora below particularly when it happens to be the concurrent order unless it is shown that finding recorded by the fora below was perverse in the sense that no person acting on the basis of the material available to him would have returned such a finding. Considering that in the letter seeking refund there was no allegation of the Institute having not given any extra classes and having not provided study material and also that neither the extra classes nor the study material was demanded in writing at any time before asking for the refund and the child later changed to stream from science to commerce, the findings recorded by the for a below was without any cogent evidence and, therefore would be perverse with this Commission is competent to set aside in exercise of its revisional jurisdiction.
3. N.C.D.R.C, New Delhi "FIITJEE Ltd. Versus Harish Soni", Revision Petition no. 2054/2013, Decided on 08-10- 2015 As regards the terms stipulated that the student withdrawing from the coaching class midway will not be entitled to seek any refund of the fee deposited by him being unfair trade practice, we are of the view that in a case where the seat vacated on account of withdrawl by a student is admitted against the vacant seat, the refusal of the coaching institute to refund the fee cannot be said to be unfair trade practice, through, such a term may constitute an unfair trade practice in a case where the coaching institute admits a student in a place of the students who withdraws midway from the coaching course and thereby suffers no financial loss.

4. N.C.D.R.C, New Delhi "FIITJEE Ltd. Versus Balavignesh", Revision Petition no. 2684/2014, Decided on 09-01-2015 The Hon'ble National Commission upheld the validity of the no-refund clause on the ground that if the coaching is left mid- way and if the refund is permitted, Institute suffers as the seat vacated by the students remain vacant throughout the course.
5. S.C.D.R.C, Union Territory, Chandigarh "M/S Fiitjee Limited. Versus Mayank Tiwari", First Appeal No. 244/2014, Decided on 23-09-2014 The District Forum, thus, failed to take into consideration the aforesaid aspects of case (Brilliant Classes V. Shri Ashbel Sam). Had the District Forum appreciated the facts, circumstances and evidence, on record, in its proper perspective it would not have fallen into error in holding that there was deficiency in rendering service on the part of the opposite Parties.
6. N.C.D.R.C, New Delhi "FIITJEE Ltd. Versus Sajjan Kumar Gupta" Revision Petition no. 4476/2023, Decided on 21-05-2014 In the order passed by the Hon'ble Supreme court in the case of "Islamic Academy of Education vs. State of Karnatka"
(Supra), the learned Apex Court have made it very clear that if an Institute had the apprehension that a particular student may leave in midstream, they could get a bond/bank guarantee for the balance fees for the whole course. Their Lordships have also stated in this judgement that if the fees is collected in advance, the Institute is required to keep it invested in fixed deposits in a Nationalised Bank. The ratio of this judgement makes it clear that an institute is not debarred from collecting the entire fees in advance. Moreover it has not been stated anywhere in this judgement that a student is entitled to get refund, if he leaves the course midstream.6

N.C.D.R.C, New Delhi "Globsyn Buisness School Versus Mayuri Ghosh" Revision Petition no. 4464/2012, Decided on 31-05-2013 Learned Counsel for the respondent simply submitted that on account of financial crisis, complainant was compelled to withdraw his candidatures and sought refund of fees, in the light of University Grants Commission (UGC) Circular dated 23.04.2007. Learned Counsel for the petitioner submitted that as petitioner was not getting any aid from the UGC, this Circular was not applicable in the present case. Learned Counsel for the respondent could not show any document by which, it can be inferred that petitioner was getting aid from UGC and in absence of any aid, Circular issued by UGC was not applicable and petitioner has not committed any deficiency in refusing refund of Rs. 35,000/- received as admission fees. Consequently, revision petition is to be allowed and order passed by learned State Commission is set aside and complaint filed by the respondent is dismissed with no order as to costs.

Versus Mr. Varjeet Walia" First Appeal no. 233/2008, Decided on 25-07-2013 The District Forum has directed the appellant (coaching institute) to refund the entire fee, which is not justified as the respondent had attended the program for 6-7 days and left the institution voluntarily, as such, the order of the District Forum is liable to be modified.

10.S.C.D.R.C, Delhi "Apeejay Institute Of Management Versus Prashant Ashok", Appeal No. 07/320, Decided on 27-07-2007 Non refund of admission fee is not a deficiency in service. Admission fee is not a consideration for admission and the service which the college was to render to the students in the matter of his pursuing studies in the college after admission.
11.Supreme Court of India "Islamic Academy Of Education Versus State Of Karnatka", Civil Appeal No. 350/1993, Decided on 14-08-2003 It must be mentioned that during arguments it was pointed out to us that some educational institutions are collecting, in advance, the fees for the entire course i.e. for all the years. It was submitted that this was done because the institute was not sure whether the student would leave the institute midstream. It was submitted that if the student left the course in midstream thEn for the remaining years the seat would lie vacant and the institute would suffer. In our view an educational institution can only charge prescribed fees for one semester/year, if an institution feels that any particular student may leave in midstream then, at the highest it may require that student to give a bond/bank guarantee that the balance fees for the whole course whould be received by the institute even if the student left in midstream. If any educational institution has collected fees in advance, only the fees of that semester/ year can be used by the institution. The balance fees must be kept invested in fixed deposits in a nationalized bank (emphasis supplied). 1916,1917 and 1970/2000One thing has to be kept in mind and that is that we cannot go against the terms of contract between the parties unless of course, the terms are illegal and the contract void. It has not been suggested before us that the terms and the conditions stipulated in the application form are in any way is illegal. Some of the conditions may appear to be unreasonable but that would not make contract void or even voidable. A consumer Forum has no jurisdiction to strike down a condition in the contract howsoever unreasonable it may appear to be so, so long it is not unlawful.
