1. Heard Sri Tahir Husain Farooqui, learned counsel for the petitioner and Sri Virendra Kumar Gupta, learned standing counsel for the State-respondents.
2. This writ petition has been filed praying for the following relief:
"(a) issue a writ, order or direction in the nature of Certiorari quashing the Cancellation order of loudspeaker permission dated 17.02.2023 passed by the Sub-Divisional Magistrate (Sadar), Tehsil & District- Budaun/ respondent no.2 (Annexure No.4 to this writ petition)."

By the impugned order dated 17.02.2023, the permission dated 28.06.2022 has been withdrawn on the finding that in breach of conditions of permission, 'namaj' is being conducted by use of loud-speaker in high volume. The guidelines and conditions of the permission granted by order dated 28.06.2022 passed by the respondent No.2 for use of only one loud-speaker within the campus of 'Gausia Masjid' in Village Jalalpur from 06:00 A.M. to 10:00 P.M., are reproduced below:
"2. उपरोक्त अनुज्ञा निम्न शर्तों के अधीन रहेगी-
(क) शांत क्षेत्र मे किसी प्रकार के संगीत/ढोल/हार्न/ लाउड स्पीकर/लोक संबोधन प्रणाली का प्रयोग प्रतिबन्धित है।
(ख) सार्वजनिक स्थान जहां लाइड स्पीकर या लोक सम्बोधन प्रणाली (Public Adress System) या ध्वनि का कोई अन्य स्त्रोत जैसे- डी०जे० आदि उपयोग में लाया जा रहा है, में ध्वनि स्तर, क्षेत्र के लिये निर्धारित ध्वनि स्तर से 10 डेसीबल (d(B)A) अधिक या अधिकतम 75 डेसीबल (d(B)A) जो भी कम हो, से अधिक नहीं होगा।
(ग) लाउड स्पीकर या लोक सम्बोधन प्रणाली या कोई ध्वनि उत्पन्न करने वाले उपकरण जैसे लाउडस्पीकर आदि का प्रयोग परिसर की चाहरदीवारी के अन्दर ही किया जाना अनुमन्य होगा। यदि लाउडस्पीकर की आवाज परिसर की चाहरदीवारी के बाहर आती हुई पायी गयी तो उपरोक्त संबंधित के विरूद्ध विधिक कार्यवाही की जायेगी तथा लाउडस्पीकर एंव एमपलीफायर शासन के पक्ष में जब्त कर लिया जाएगा।
(घ) किसी निजी स्वामित्त के परिसर में ध्वनि उत्पन्न करने वाले उपकरण का प्रयोग इस प्रकार किया जाये कि उत्पन्न ध्वनि का स्तर ध्वनि मानक के स्तर से 5 डेसीबल (d(B)A) से अधिक नहीं होगा।
(ड़) ध्वनि के संबंध में आस-पास की वायु गुुणत्ता के मानक ध्वनि प्रदूषण (विनियमन और नियंत्रण) नियम, 2000 यथासंशोधित के नियम -3(1) और 4(1) के अन्तर्गत अनुसूची में दी गई तालिका के अनुरूप लागू होंगे, जिसका अनुपालन आपको करना होगा।"

In paragraphs-3 and 4 of the writ petition, the petitioner has stated that he is a member of committee of 'Gausia Masjid', which was established about 100 years ago and no loud-speaker was used in the said mosque for ajan/ namaj or any religious function. In paragraph-6, it has been stated that application dated 30.04.2022 was moved before the respondent No.2 for granting permission to use loud-speaker in the premises of the aforesaid mosque. In none of the paragraphs of the writ petition, the petitioner has denied either breach of condition No.(ga) of the permission dated 28.06.2022 nor has denied the following findings recorded in the impugned order dated 17.02.2023:-
"थानाध्यक्ष, कादरचौक द्वारा उक्त निर्गत की गयी अनुमति के संबंध में अपनी आख्या दिनांक 19.12.2022 एंव पूरक जांच आख्या दिनांक 08.2.2023 प्रस्तुत कर अवगत कराया गया है कि मस्जिद पर कभी भी लाउडस्पीकर लगाकर नामज/अजान अदा नही की गयी। अनुमति के उपरान्त लाउडस्पीकर लगाकर नमाज/अजान अदा की जा रही है तथा लाउडस्पीकर तेज आवाज में बजाया जा रहा है, मा० उच्च न्यायालय व राज्य सरकार की गाइड लाइन का अनुपालन नहीं किया जा रहा है, जिससे हिन्दू समुदाय में आक्रोश बना हुआ है एंव कभी भी शान्ति व्यवस्था बिगड सकता है। थानाध्यक्ष, कादरचौक उझानी द्वारा उक्त निर्गत अनुमति को निरस्त किये जाने की संस्तुति की गयी है।
अतः थानाध्यक्ष कादरचौक द्वारा प्रस्तुत की गयी आख्या/संस्तुति के आधार पर कानून व शान्ति व्यवस्था एंव गांव में साम्प्रदायिक सद्भावना बनाये रखने के दृष्टिगत आवेदक श्री जाहिद हसन पुत्र श्री मो० इशहाक नि० ग्राम जलालपुर, थाना कादरचौक, तहसील बदायूँ को ग्राम जलालपुर स्थित गौसिया मस्जिद पर पत्रांक 13/आ०ले०/ ला० स्पीकर-अनुज्ञा/स्थायी /2022-23 दिनांक 28.06.2022 के द्वारा लाउडस्पीकर प्रयोग करने की दी गयी अनुमति तत्काल प्रभाव से निरस्त की जाती है।"
5. Since the petitioner has not denied that loud-speaker was being used in high volume and the guidelines and conditions were not being observed, therefore, we do not find any good reason to interfere with the impugned order.
6. For the reasons afore-stated, the writ petition is dismissed.
