Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in Udwant Nagar P.S. Case No. 232 of 2014 registered for the offences punishable under Sections 341, 323, 504, 506, 307, 387 and 379 of the Indian Penal Code.

It has been contended that no such occurrence, as alleged, ever took place and the petitioner has been falsely implicated in the case due to political rivalry. The informant and the petitioner are co-villagers and they are known to each other by face and by name and on such a background, the allegation of demand of rangdari etc. is highly improbable.

It has further been contended that the offence under Section 307 of the Indian Penal Code is not made out as no firing had ever taken place.

Learned counsel for the State has opposed the prayer for bail.

Be that as it may, having regard to the facts and circumstances of the case, the petitioner is directed to be released Patna High Court Cr.Misc. No.42308 of 2014 (2) dt.24-11-2014 2/2 on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 232 of 2014.
