01. 1. Heard the learned counsel for the Petitioner and the State.

2. By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 420, I.P.C. in connection with Chandrasekharpur P.S. Case No.167 of 2023 corresponding to G.R. Case No.412 of 2023 pending in the court of the learned J.M.F.C.-II, Bhubaneswar.

It is alleged and revealed from the F.I.R. that the informant has a grocery shop at Housing Board Colony, Bhubaneswar, and one day the accused (present Petitioner) who is a staff of Bharat Pe, installed one Bharat PE QR Code in the shop of the Informant for easy online transactions. It is alleged that said Srikanta Palta offered the Informant-complainant one Bharat Pe Credit Card and one day he came to the shop of the complainant and told him regarding verification of the Bharat Pe and asked him to tell the OTP from his mobile. But, after sometime the OTP was supplied by the Informant Page 1 of 2 to him, a sum of Rs.9134/- was deducted from his bank account by way of fraud. And, further thereafter a total of Rs.1,21,887/- has been deducted from the account of the informant by way of fraud. The informant alleges that the aforesaid amount from his account has been deducted and taken away by the present petitioner by applying fraudulent tactics.

4. Having regard to the nature of the allegation, seriousness and gravity of the offence and the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail in favour of the Petitioner. Accordingly the prayer for bail stands rejected and the ABLAPL is dismissed.
