Heard, Shri Abhay Kumar Ojha, learned Counsel for the petitioner, Shri Anand Dwivedi, learned counsel for Union of India and Shri Ravi Prakash Sharma holding brief of Shri Krishna Chandra Srivastava, learned counsel for the respondent no.3.
Considering the nature of order proposed to be passed issuance of notice to opposite party no.2 is hereby dispensed with.
Learned counsel for the petitioner submits that privilege leave encashment has not been paid, though the petitioner has retired way back on 30.06.2021. It is further submitted that the Company is in profit and there is no financial difficulties in marking the payment of the dues of the petitioner. To substantiate this fact, learned counsel for the petitioner has drawn attention of this Court on letter dated 29th of September, 2022 which relates to Industrial Dearness allowance to be paid to the employees of the Company.
Nevertheless, considering the nature of grievance and the arguments advanced by learned counsel for the petitioner, the petition is disposed off with the direction to the respondent no.3 to look into the matter, verify the facts and take a decision as regards payment of privilege leave encashment to the petitioner within two months from the date a copy of this order is submitted. Needless to say that if any interest is payable on the said amount, the same shall also be paid as per rules.
