2/11.06.2018           Heard learned counsel appearing for the petitioner and the

learned counsel for the State, who opposes the prayer for bail.

The petitioner is an accused for allegedly committing offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code and Section 12 of POCSO Act, in connection with Karon P.S. Case No. 36 of 2017 [G.R. No. 405/2017, POCSO Case No. 25/2017], pending in the Court of 1st A.D.J., Deoghar.

Prayer for bail of this petitioner was earlier rejected by this court vide order dated 27.11.2017 in B.A. No. 7773/2017. The petitioner has renewed his prayer for bail on the ground that charge has been framed in January, 2018, but there is no substantial progress in the trial.

Learned counsel for the petitioner submits that only three witnesses have been examined in this case till date.

In view of the fact that the trial is in progress and the prayer for bail of this petitioner was earlier rejected by this Court on merit, I am not inclined to release him on bail. Accordingly, his prayer for bail is hereby rejected.

However, the trial court is directed to take all possible steps so that the trial can be concluded within a period of six months from the date of receipt/production of a copy of this order.
