Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High CourCourt may be
pleased topleased to issue an appropriate Order, Direction or Writ more
particularly one in the nature of Writ of Mandamus, declaring the action of the
respondent nos. 3 to 7 in interfering and taking steps to dig water bund in the
petitioner agricultural
cultural land in Sy. No. 83 admeasuring an extent of Ac 1.15
cents situated at Chinna Kothapalli Village, Addanki Mandal, Bapatla District
without conducting joint survey in respect of Survey Nos. 77, 83 and 84 at
Chinna Kothapalli Village, Addanki Mandal, Bapatla District which are situated
adjacent to with each other, without any notice and without following the
procedure contemplated under the Statute, as being illegal, arbitrary, unjust
and violative of Article 21 and 300-A of the Constitution of India and
consequently direct the respondent authorities not to take any coercive steps
without conducting joint survey in respect of land Survey Nos. 77, 83 and 84
at Chinna Kothapalli Village, Addanki Mandal, Bapatla District and without
following the due process of Law and pass

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased
pleased to direct the respondents herein not to interfere with the
peaceful possession and enjoyment of the petitioner in respect of the
agricultural land in Sy. No. 83 admeasuring an extent of Ac 1.15 cents
situated at Chinna Kothapalli Village, Addanki Mandal, Bapatla District without
conducting joint survey in respect of land in Survey Nos. 77, 83 and 84 at
Chinna Kothapalli Village, Addanki Mandal, Bapatla District, pending disposal
of the main Writ Petition, and pass

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased
pleased to vacate the interim order dated 28.04.2023 in W.P.No.11132 of
2023 and also dismiss the writ petition and pass

The Court made the following:
ORDER
This writ petition is filed questioning the action of respondent nos. 3 to 7 in interfering and taking steps to dig water bund in the petitioner's agricultural land admeasuring Ac.1.15 cents in Survey No.83 of Chinna Kothapalli Village, Addanki Mandal, Bapatla District, without conducting survey.
2. In the counter affidavit filed by respondent no.6-Tahsildar, it was clearly mentioned that the authorities had never interfered with the possession and enjoyment of the petitioner over the subject land.
3. Ms.Kavitha Gottipati, learned counsel for the petitioner, prayed to close the writ petition recording the contents of the counter affidavit.
4. In view of the above, as the respondents clearly stated in their counter that the authorities had never interfered with the possession and enjoyment of the petitioner over the subject land, this writ petition can be closed.
5. Accordingly, this writ petition is closed. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
