1. Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 439 Cr.P.C. on behalf of the Applicant-Rajkumar @ Raju for grant of Interim Bail on medical ground in FIR No. 0490/2025 dated 31.05.2025 registered under Sections 338/336(3)/340(2)/61(2) BNS at P.S. Burari.
2. The Medical Report dated 09.10.2025 has been received wherein it is stated as under:-
"It is to be submitted that, the Inmate patient was undergone Stage-I Urethroplasty surgery in Safdarjung hospital for his complaint of urethral stricture in December 2024 and thereafter advised for stage-II Urethroplasty surgery after 3-6 months.
At present, the inmate patient has been advised and planned for Stage-II Urethroplasty surgery at Safdarjung Hospital. Before surgery he has been advised multiple investigations for PAC (Pre Anaesthetic Checkup). Recently, the inmate patient was examined in DDU This is a digitally signed order.

He was advised Surgery for cataract at DDU Hospital and currently is on work up investigations before surgery. Inmate patient presented in dispensary on multiple occasions for his complaints of shortness of breath, burning micturition, pain abdomen and hematuria (blood in urine). He is undergoing pre anaesthetic check up for both surgeries (stage-II Urethroplasty and Right Eye Brown Cataract). The advised investigations has been done and date for both surgeries are yet to be given by Safdarjung and DDU Hospital."

In view of the medical condition of the Applicant, it is evident that he needs immediate treatment, he is admitted to Bail for 30 days from the date of his release upon furnishing a personal bond in the sum of Rs.25,000/- with one Surety of the like amount, to the satisfaction of the learned Trial Court, and further subject to the following conditions:-
a) Applicant shall not leave Delhi/NCR without prior permission of the Court;
b) Applicant shall appear before the Court as and when the matter is taken up for hearing;
c) Applicant shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;
d) Applicant shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi;
e) Applicant shall not indulge in any criminal activity and shall This is a digitally signed order.

f) Applicant shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner.
4. Copy of the Order be sent to the Jail Superintendent for information and necessary compliance.
5. Upon expiry of period of Interim Bail, as stated above, the Applicant shall surrender before the concerned Jail Superintendent.
6. The Bail Application stands disposed of.
