1. This is an application under Section 151 of CPC, 1908 seeking modification of the Order dated 13.10.2025 to the extent that parties be referred to ad hoc arbitration before the Arbitrator in place of Institutional Arbitration.
2. Learned counsels of the parties, on instructions, state that during the pendency of the proceedings they have arrived at a Settlement Deed dated 05.11.2025 and binding the parties to the terms of the Settlement deed, the petition itself be disposed of.
3. Ms. Mukherjee, learned counsel for the respondent, has handed over a Demand Draft dated 29.10.2025, in the name of TDI Infratech Ltd This is a digitally signed order.

6. Since the arbitration proceedings have never commenced and the matter has been settled, there is no further requirement for the arbitration proceedings.
