This Civil Suit is preferred, under Order IV Rule 1 O.S. Rules Read
with Order VII Rule 1 of CPC and under Sections 51, 55 and 62 of the
Copyright Act, 1957 praying
a) For a permanent injunction restraining the Defendants, their
men, agents, servants, assigns, heirs, representatives, successors, affiliates
or any other persons claiming through/under them from in any manner
publicly performing or communicating the schedule mentioned sound
recordings works of the plaintiff to the public or allowing their premises or
any premises under their control to be used for the said purpose without
license from the plaintiff or in otherwise infringing copyright in any work
owned and licensed by the plaintiff.
b) Costs of the suit; and
c) Pass such further or other orders as this Hon'ble Court may deem
fit and proper in the circumstances of the case and thereby render justice.

JUDGMENT
Mr.P.V.Balasubramaniam, learned counsel of M/s.BFS Legal [Law Firm] on behalf of plaintiff and Mr.J.Srinivasa Mohan, learned counsel on record for defendants 1 and 2 and Mr.M.Arun, learned counsel on record for third defendant are before this Commercial Division.

There is an interlocutory application in O.A.No.1192 of 2018 and http://www.judis.nic.in 3 respondents 1 and 2 therein, who are defendants 1 and 2 respectively in this suit have filed a common counter affidavit dated 30.01.2019. With regard to third defendant their stated position is contained in plaint document No.36, dated 25.09.2018.
3. To be noted, the stated position of defendants 1 and 2 also has been articulated in the aforesaid counter affidavit.

Considering the narrow scope of the entire lis and the prayer, all the three learned counsel before me submitted and consented for disposal of main suit itself by exercise of powers of this Commercial Division to pass a summary judgment being powers under Order XIII-A of amended 'The Code of Civil Procedure, 1908' ('CPC' for brevity) as amended by 'The Commercial Courts Act, 2015' ('said Act' for brevity).
5. To be noted, the grounds on which a summary judgment can be passed are adumbrated in Rule 3 of Order XIII-A of amended CPC as amended by said Act. A perusal of Rule 3 of Order XIII-A of amended CPC as amended by said Act reveals that when the defendants have no real prospect of successfully defending the claim in the light of their stated position, a summary judgment can be passed when there is no other compelling reason as to why the claim in the suit should not be disposed of http://www.judis.nic.in 4 before recording oral evidence.
6. This takes us to the stated position of defendants. In the counter affidavit of respondents 1 and 2 in O.A.No.1192 of 2018, stated position of defendants is articulated in paragraphs 4, 5, 7 and 8, which read as follows:
'.........4. I deny the allegations in para 16 of the affidavit under counter. I categorically state that there are no celebrations, functions, live events, shows and performances on a large scale for Christmas, New Year Holiday season or any festive season. We do not invite any person/guest for the alleged non-existent events.
5. In as much as we do not organize any functions, or events, question of making any profits on such events does not arise. The banquet halls alone are given out on rent and nothing extra is charged. The event complained off by the plaintiff, is a private event, which is admitted in the plaint.
7. I hereby specifically deny the allegation that we conducted an event on 15.09.18 charging entry fees and cover charges. No such event was conducted. I specifically deny the allegation that we are making profits by charging entry fees, cover charges, ticketing charges anything between Rs.2,500/- to Rs.25,000/-. I submit the charge for the hall is on the basis of food provided per person. There are no additional charges. The further allegation that we are continuing with unauthorized use and public communication of sound recordings are specifically denied as false. We have strictly informed persons taking on rent the halls, not to play any songs that require license.
8. I submit that we hereby categorically state that http://www.judis.nic.in 5 there are no complaints after the alleged incident on 20.08.18. We are strictly following the Rule of law and as stated above have made it very clear to the persons taking banquets halls on rent not to play any music/song during their private event, without obtaining license, if such songs requires license. We hereby state that we would continue to do so.'
7. As mentioned and as alluded to supra, the stated position of third defendant is articulated in plaint document No.36 being a reply letter dated 25.09.2018 and the same reads as follows:
'Media One The right thoughts Date: 25.09.2018 Dear Mr.Priti Naik, We are writing this on behalf of your letter dated 4 th September, 2018 regarding the recorded music used in the event conducted on 20th August, 2018 in The Sunway Manor, Pondicherry.
Herewith we do inform you that we are not advised by the hotel persons or any others regarding the Novex License at the time of event. And, please note that in the hotel rate contract/ promora invoice / any other prior letters they didn't mention about this. If the hotel people informed about it before the event, we would get the necessary licenses for using your music. And now we assure that we will pay that license amount immediately.
Now we got awareness about this license and we pledge you that we will get proper permissions in the future. Kindly understand our stance and keep support us for the further events.

8. Amplifying and elaborating on the stated position of defendants 1 and 2, Mr.J.Srinivasa Mohan learned counsel, on instructions, submitted that defendants 1 and 2 will ensure that it is made one of the terms and conditions i.e., getting requisite permission/approval from the plaintiff wherever applicable with regard to on ground performance of songs adumbrated in Schedule-II to the plaint while letting out the banquet halls.
In other words, it will be made one of the terms and conditions qua the guests of defendants 1 and 2, while they are letting out the banquet halls for conducting events.

With regard to third defendant, they very fairly stated that they were not aware of the license/permission qua songs, which are adumbrated in schedule-II to the plaint and there are two aspects of their stated position. One aspect is that they will pay for the three songs, which were played in the event conducted on 20.08.2018 and the second aspect is that they will ensure that permission/license is obtained from plaintiff with http://www.judis.nic.in 7 regard to Schedule-II songs in future. Both these aspects which form part of the stated position of the third defendant are recorded.

However, in the light of the trajectory of the hearing today and in the light of the fair stand that has been taken by defendants, learned counsel for plaintiff, on instructions, submits that instead of payment to plaintiff towards license fee for the three songs that were paid on 20.08.2018 with regard to on ground performance in the event conducted by the third defendant on 20.08.2018, it will suffice if third defendant is put on some terms.

In the light of the narrative supra, it is necessary to extract and reproduce the prayer paragraph in the plaint, which is in the form of a unnumbered paragraph following paragraph 33 in the plaint. This Commercial Division is requested to construe the same i.e., unnumbered paragraph as paragraph 34 and I do so. Prayer paragraph i.e., paragraph 34 reads as follows:
'For all the reasons stated above, it is most respectively prayed that this Hon'ble Court may be pleased to pass a judgment and decree:
a) For a permanent injunction restraining the Defendants, their men, agents, servants, assigns, heirs, representatives, successors, affiliates or any other persons claiming through/under them from in any manner publicly performing or communicating the schedule mentioned sound recordings http://www.judis.nic.in 8 works of the plaintiff to the public or allowing their premises or any premises under their control to be used for the said purpose without license from the plaintiff or in otherwise infringing copyright in any work owned and licensed by the plaintiff.
b) Costs of the suit; and
c) Pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thereby render justice.'
12. A perusal of prayer paragraph reveals that there are three limbs of prayers, which have been set out as sub-paragraphs (a), (b) and (c). In the light of the trajectory of the hearing today and the narrative supra, sub-paragraphs (b) is not acceded to or in other words, there shall be no decree for costs. With regard to sub-paragraph (c), it is the usual residuary limb in any prayer paragraph and in the light of the trajectory supra, no further or other orders are necessary.
13. There shall be a decree in terms of sub-paragraph (a) in this suit.
It is made clear that this decree in terms of sub-paragraph (a) is a decree in personam qua the third defendant and shall not be considered as a right in rem qua the plaintiff. With regard to on ground performance for the event conducted on 20.08.2018, in the hotel of defendants 1 and 2, as the third defendant is only an Event Manager, I deem it appropriate not to put the third defendant on terms as sought for by the plaintiff. This is more so, in the light of the categorical and fair stand of the third defendant that they http://www.judis.nic.in 9 will get requisite license in future.
14. Besides the prayer paragraph, it is also necessary to set out schedules-I and II to the plaint, which give the list of songs (in which plaintiff claims copyright) in a tabular form. To be noted, this tabular form gives the name of the cinematograph film as well as the opening lyrics of the songs besides the music label. The same is extracted and appended to the decree and it shall form part of the decree.
Suit is decreed on above terms. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
