4 24-03-2017Heard both sides.
The petitioner seeks bail in Kaluahi P.S. case No. 118 of 2014 under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
The informant alleged that he got information that some criminals were standing by the side of Reliance tower situated behind Sai Baba Jewelers. When the informant and others reached there the criminals opened fire on the police personnel. On chase, two persons, namely, Mukesh Yadav and Rajnit Yadav, the petitioner, were apprehended. From the possession of petitioner looted ornaments were recovered.
The learned counsel for the petitioner submits that name of the petitioner figured in the case in the confessional statement of Mukesh Yadav. The petitioner did not participate in any dacoity but some ornaments, said to have been looted, were Patna High Court Cr.Misc. No.8623 of 2017 (4) dt.24-03-2017 2/2 recovered from the possession of petitioner.
It appears that petitioner was also arrested immediately after the occurrence and petitioner and others made indiscriminate firing on the police personnel. Looted ornaments were also recovered from the possession of the petitioner.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
Since the petitioner is in jail since 25.09.2014, the trial court is directed to expedite the trial, hold the same on day to day basis and conclude the trial within six months from the date of receipt of this order.
The Superintendent of Police, Madhubani is directed to ensure the presence of non examined prosecution witnesses of Kaluahi P.S. case No. 118 of 2014, corresponding to Sessions Trial No. 99 of 2015, in the court of learned Additional Sessions Judge-II, Madhubani so that the trial must be concluded within six months.
Let a copy of this order be sent to learned trial court as well as Superintendent of Police, Madhubani for information and needful.
