ORDER
Shri Gyan Prakash Nigam, the appellant has filed this appeal dated 29.11.2010 before the Commission against the Food Corporation of India, Lucknow for not providing information to his RTI-request dated 1.9.2010, which came up for hearing on 21.3.2011. The appellant was present in person, whereas the respondents were represented by Shri Vinod Kumar, Manager and Shri Tula Ram, AGI (M).
2. The appellant filed RTI-request dated 1.9.2010, seeking information on four RTI-queries pertaining to pending vigilance case against him.
3. When the appellant did not get any response from CPIO, he preferred first-appeal on 13.10.2010 before AA.
4. During the hearing the respondents submitted that the appellant submitted his RTI-request dated 1.9.2010 followed by first-appeal dated 13.10.2010. His case was processed and information was provided to him by CPIO vide letter No. East.3 (RTI)/GP Nigam/10/586 dated 12.1.2011.

5. After hearing the parties and on perusal of the relevant documents on file, the matter is remitted to FAA, FCI, Regional Office (UP), Lucknow with the direction to treat second-appeal dated 29.11.2010 as first-appeal and pass speaking order within the stipulated period under the RTI Act.
The appeal is disposed of with the above directions.
