          Petition under Section 430 (1 & 2) of BNSS, is filed praying that in the
    circumstances stated in the affidavit filed in support of the petition, the High
    Court may be pleased to suspend the execution of sentence dated 30.3.2026
    passed in C.C.No.94 of 2018 (old CC No. 37 of 2014) on the file of the Special
    Court for Trial of Cases under Prevention of Corruption             Act,   1988,
    Rajamahendravaram, pending disposal of CRLA No. 241 of 2026, on the file
    of the High Court.
          The petition coming on for hearing, upon perusing the Petition and the
    affidavit filed in support thereof and upon hearing the arguments of
    Sri G.Vijaya Saradhi, Advocate for the Appellant and of Sri S.Syam Sunder
    Rao, Standing Counsel-cum-Speciai Public Prosecutor for ACB, the Court
    made the following

ORDER:

"Heard Sri G.Vijaya- Saradhi, learned counsel for the petitioner/appellant/A1 and learned counsel representing Sri S.Syam Sunder Rao, learned Standing Counsel-cum- Special Public Prosecutor for ACB.

Petitioner is accused No.1 in Calendar Case No.94 of 2018 on the file of the learned Special Judge for Trial of Cases under Prevention of Corruption Act, Rajamahendravaram.

Learned counsel for the petitioner would submit that the petitioner/convict was convicted for the offence under Sections 7 and 13{1)(d) r/w 13(2) of PC Act, 1988 and accordingly the petitioner/convict was convicted and sentenced to undergo simple imprisonment for a period of one (01) year and to pay a fine of Rs.1000/- (Rupees One Thousand only), in default, shall undergo simple imprisonment for a period of two (02) months for the offence under Section 7 of the PC Act, 1988.

The petitioner/convict was further sentenced to undergo simple imprisonment for a period of one (01) year and to pay a fine of Rs.1000/- (Rupees One Thousand only), in default, shall undergo simple imprisonment for a period of two (02) months for the offence under Section 13(1 )(d) r/w 13(2) of the PC Act, 1988.

Learned counsel for the petitioner/appellant would further submit that the petitioner paid the fine amount and filed original receipt along with the appeal grounds.

Learned counsel for the petitioner/appellant would further submit that the petitioner was released on bail by the learned trial Court under Section 389(3) of Cr.P.C., corresponding to Section 430(3) of BNSS, 2023 till 20.04.2026 to enable him to file the appeal. The appellant preferred the appeal, challenging the judgment on various grounds. He would further submit that the sentence of imprisonment imposed by the learned trial Court is a fixed sentence for a period of one (01) year, and there are fair chances to succeed In the appeal, and there is no possibility of taking the appeal in the near future. Considering the circumstances, the order of sentence imposed by the trial Court may be suspended, pending disposal of the appeal.

Learned Standing Counsel-cum-Special Public Prosecutor for ACB opposed the application. However, no written objections filed.

Considering the submissions, facts of the case and as the sentence imposed by the trial Court is fixed a sentence of one (01) year, and as there is no possibility of hearing the appeal in the near future, "the order of sentence of imprisonment alone imposed by the learned Special Judge for Trial of Cases under Prevention of Corruption Act, Rajamahendravaram vide judgment dated 30.03.2026 passed in C.C.No.94 of 2018 be suspended, pending disposal of the appeal, subject to the same terms and conditions imposed by the learned trial Court in the application filed U/s.389(3) of Cr.P.C., 1973 equivalent to Section 430(3) of BNSS, 2023 in addition to the following conditions":

i) The petitioner/appellant/AI shall not leave the country without permission of the Court.
ii) If the petitioner/appellant/AI violates any of the above conditions, the prosecution is at liberty to file an application seeking cancellation of the bail.
