Re: W.P.A.(P) 162 of 2021 The advocate-on-record for the writ petitioners activated the administration of this court, as a result of which the Hon'ble the Chief Justice was pleased to constitute a sitting of this bench before the returnable date of this matter on 25th March, 2022 to hear the alleged grievance of the writ petitioners.
The alleged grievance was that Disari Public School, Kumarpur, Haldia in violation of the order of this court dated 18th February, 2022 was dis-allowing some students for a board examination which was to commence soon.
Accordingly, we sat today after placing the writ application and all connected applications in the list.
The grievance appears to be wholly imaginary and the apprehension totally unfounded. 8
Learned counsel for the school informs us that no board examination is to be held in the near future. Only the third terminal examination is to be conducted by the school.
We take on record a written communication dated 1st March, 2022 signed by the principal of the school to the following effect:
"Dear Parent, Please note that all students will be allowed to sit at the 3rd Terminal Examinations irrespective of their payment status whether paid or unpaid. Hence, you can be assured that all students are entitled to appear and no such admit card will be issued, as time is very short to prepare and issue it to anyone.
Thanking You, Principal."
No further order is required. We only observe that all pending issues will be considered by the court on the returnable date of this writ application and connected applications on 25th March, 2022 and that all parties shall till further orders are made in these matters, comply with the subsisting interim order.
