Facts:
1. Appellant submitted RTI application dated 16 February 2012 before the CPIO, East Delhi Municipal Corporation, Delhi seeking details in respect of the terminal/retirement benefits as paid to the Appellant upon his retirement from the Public Authority as Safai Karamchari (Ward No. 237) and other details of his service books, personal files and pension book.
2. CPIO did not provide any reply to the Appellant.
3. Appellant preferred first Appeal to the First Appellate Authority.
4. Vide Order dated 16 June 2012, CPIO was directed to provide clear and specific information to the Appellant within 30 days.
5. Being aggrieved and not being satisfied by the above response of the public authority, the appellant preferred second appeal before the Commission.
6. Matter was listed for hearing today.

7. Commission notes that the CPIO had directed a junior functionary of the rank of UDC to appear before the Commission on his behalf at the hearing today which is contrary to the requirements of the RTI regime. Also in the Notice for Complaint: No. CIC/DS/A/2013/001006 Hearing no. CIC/DS/A/2013/001006 dated 21 June 2013 it is clearly directed that the person authorized to represent the public authority before the Commission will be 'an officer not below the rank of CPIO'. Therefore Commission has not held the hearing in this matter today.
8. Accordingly, CPIO is warned to observe the prescribed decorum and not waste scarce resources of the public authority and the time of the Commission future. He is directed to appear before the Commission in the present case on 7.8.2013 at 2.45 PM.
