(5)Out of the names so recommended under sub-section (4), the Executive Council shall appoint persons in order of merit :Provided that where Executive Council proposes to make the appointment otherwise than in accordance with the order of merit arranged by the committee, the Executive Council shall record its reasons in writing and submit its proposal for sanction of the Kuladhipati.
