The petitioner contends that though he tendered the information as regards commission of offence under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, the police have recorded a non cognisable offence and an application has been tendered to the Superintendent of Police complaining the action of the police after three weeks of the alleged incident. It would be open for the petitioner to tender a complaint to the Court in accordance with the provision of Code of Criminal Procedure and there shall be no impediment in tendering the complaint merely on account of registration of N.C. by the police.
2. With liberty as aforesaid the writ petition is disposed of.
