O R D E R (O R A L)

The issue involved in these OAs is same and has already been adjudicated by the Chandigarh Bench vide judgment dated 28.11.2019 in OA No. 1067/2017. Hence a common judgment is being passed. 20
OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 A. OA No. 1974/2015 with MA No. 3871/2017 1.0 Being aggrieved with the downward revision of pay issued vide order No. 23/S-1(B)/2015 dated 07.04.2015, this OA was filed by the applicants. The operation of this letter was stayed vide interim order dated 27.05.2015. In due course, some of the applicants had superannuated from service and their retiral dues settled, duly ignoring this order dated 07.04.2015. 2.0 Sh. R. K. Nagpal, the Applicant No. 1 superannuated on 30.04.2019. The Director General, All India Radio issued a Certificate on 12.04.2019, which reads as under:-
"As per the information furnished by Centralized Vigilance Desk (DG:AIR & DG:DDn) and Ministry of Information and Broadcasting no vigilance case is either pending or being contemplated against Shri R. K. Nagpal, Assistant director Programme (IRLA No. 12753), AIR, Rohtak, who is due for retirement from Government Service w.e.f. 30.04.2019 (AN) on attaining the age of superannuation. However, three complaints are under processing in Vigilance Section, DG:AIR."
2.1 This applicant pleads that while for some others in the OA, who have since retired, their retiral dues have been paid in keeping with the stay order which was already granted on 27.05.2015, however, despite the vigilance clearance letter dated 12.04.2019, Sh. R. K. Nagpal, the Applicant No. 1 herein, has not been granted his retiral dues including even provisional pension. The applicant has preferred the MA No. 647/2020 seeking his retiral dues.
2.2 The applicant further brings out that the office order dated 07.04.2015 was a subject matter of litigation before the Chandigarh Bench of this Tribunal in OA No. 1067/2017 wherein the judgment was 21 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 pronounced on 28.11.2019 and the Tribunal was pleased to quash and set aside the office order dated 07.04.2015. Accordingly, the respondents are now required to release his retiral dues.
3.0 The respondents brought out that the said decision of the Chandigarh Bench has since been challenged before the Hon'ble High Court of Punjab & Haryana at Chandigarh and petition has since been filed vide Diary No. 3657091 on 02.03.2020. However, the matter is yet to come up for hearing before the Hon'ble High Court.
4.0 In this connection, the applicants drew attention to an order passed by the Ernakulam Bench of the Tribunal in OA No. 134/2012 dated 25.09.2012 in the matter of K. S. Rajendra Kumar & Anr. Vs. Union of India & Ors. The Ernakulum Bench of this Tribunal had made certain observations in respect of certain orders which may have been stayed vis-à- vis those where the order was quashed and set aside. These observations are reproduced here:-
"While considering the effect of an interim order staying the operation of the order under challenge, a distinction has to be made between quashing of an order and stay of operation of an order. Quashing of an order results in the restoration of the position as it stood on the date of the passing of the order which has been quashed. The stay of operation of an order does not, however, lead to such a result. It only means that the order which has been stayed would not be operative from the date of the passing of the stay order and it does not mean that the said order has been wiped out from existence."
It is pleaded that now since order dated 07.04.2015 stands quashed, the import of this order cannot be implemented. 5.0 In keeping with the above, the applicants plead that in the instant case, order dated 07.04.2015 has since been quashed and set aside. Even 22 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 prior to such quashing, the respondents had implemented the stay granted by the Tribunal on 27.05.2015 to some other similarly placed employees and their retiral dues were released without implementing the reduction envisaged by this order dated 07.04.2015 though after taking an undertaking that if any recovery become due, same shall be paid by such employees.
Accordingly, there is no reason now, not to release the retiral dues in respect of the applicant No. 1, Sh. R. K. Nagpal and especially since vigilance clearance was also accorded to 12.04.2019 (para 2 supra). It was pleaded that a mention of "three complaints are under processing in Vigilance Section" in letter dated 12.04.2019, cannot be a sufficient cause for not releasing retiral dues.
6.0 The respondents drew attention to a subsequent letter issued by Ministry of Information and Broadcasting where the Director General, All India Radio wrote a letter dated 25.02.2020 to their counsel in the instant OA, wherein it is mentioned as under:-
"3. Vigilance status of Sh. Nagpal was received from Vigilance Division wherein it was mentioned that some complaints against Shri Nagpal are under process. On the basis of this status vigilance certificate was sent to PAO(IRLA) vide letter dated 12.04.2019 (copy enclosed). PAO (IRLA) vide letter No. PAO/IRLA/I&B/PEN/2019-
20 dated 03.01.2020 (copy enclosed) addressed to HOO, AIR, Rohtak has requested to furnish the clear vigilance certificate and to update the emoluments and recoverable amount on Bhavishya Portal. The Directorate vide letter dated 06.02.2020 (copy enclosed) has again sought vigilance status from Vigilance Section, Ministry and Centralized Vigilance Desk. On receipt of vigilance status, the same will be forwarded to PAO (IRLA) for necessary action." 23
OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 In keeping with this letter, since there is no clear vigilance certificate, the retiral dues are not released. 7.0 Matter has been heard. Learned counsel Sh. M. K. Bhardwaj represents the applicants and learned counsel J. P. Tiwari represents the Respondent No. 1 and learned Ms. Madhusmita Bora represents the Respondent No. 2 & 3. 8.0 It is noted that downward pay fixation which was to be done in terms of letter dated 07.04.2015, was initially stayed by the Tribunal on 27.05.2015 and the same has been given effect to by the respondents for some other similarly placed retired employees where as similarly placed Sh. R. K. Nagpal has not been given such retiral dues.
9.0 Further the subject matter of this OA No. 1974/2015 is exactly the same as was adjudicated by the Chandigarh Bench in OA NO. 1067/2017, wherein the said letter dated 07.04.2015 has since been quashed and set aside by the Chandigarh Bench vide their judgment dated 28.11.2019.
10.0 It is true that the respondents have challenged the said order by the Chandigarh Bench before the Hon'ble High Court of Punjab & Haryana, however neither a notice has yet been issued nor is there any stay on the Tribunal's direction.
However, now since the respondents have preferred a petition before the Hon'ble High Court of Punjab & Haryana, the respondents can take an undertaking from the concerned employees to whom retiral dues are yet to be released, to the effect that they will be required to refund such of the amounts as may 24 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 become necessary in terms of decision by the Hon'ble High Court of Punjab & Haryana.
11.0 The reasons for not releasing the retiral dues to Sh. R. K. Nagpal are very vague in that there are some complaints against Sh. R. K. Nagpal which are under process. No charge sheet has yet been issued. The respondents have also not even averred/pleaded that a decision has been taken by the Competent Authority to issue a charge sheet. Therefore, this is not a sufficient ground to withhold the retiral dues.
12.0 In view of forgoing, plea to release the retiral dues to Sh. R. K. Nagpal, duly ignoring order dated 07.04.2015, as has been prayed in the MA No. 3871/2017, is gaining acceptability. 13.0 The instant OA is accordingly disposed off in terms of judgment dated 28.11.2019 subject to directions as adjudicated by the Hon'ble High Court of Punjab & Haryana, for which a petition has been filed by the respondents vide Diary No. 3657091 on 02.03.2020.
In case, as a result of adjudication by the Hon'ble High Court, certain amounts are to be refunded by the applicant, he shall refund the same fully within the date so specified by the respondents. Therefore, for the purpose of releasing retiral dues, the respondents shall take an undertaking from concerned applicants as per Para 10 above. Thereafter, the respondents are directed to release the retiral dues within a period of eight weeks under advice to the applicant.

OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 14.0 The respondents have also preferred MA No. 3871/2017 which was to correct pay fixation as per order dated 07.04.2015 by vacating stay on the same vide orders dated 27.05.2015. This MA has become infructuous in view of quashing of letter dated 07.04.2015 by the Chandigarh Bench. This MA stands dismissed as having become infructuous.
15.0 Accordingly, OA No. 1974/2015 is disposed off with the aforesaid directions. No costs.
16.0 CP No. 53/2020 has also become infructuous, hence, same is also disposed of.
B. OA No. 1956/2015 with MA No. 3537/2017 & MA No. 3963/2019 1.0 In the instant case, the applicants (total 73) were aggrieved with the pay fixation order dated 07.04.2015. This was stayed vide order dated 27.05.2015. Out of those 73 applicants, some had already retired prior to the grant of stay. Thereafter, even though their retiral dues have been paid ignoring the pay fixation order dated 07.04.2015, however, certain recoveries were subsequently ordered. Those recoveries are presently lying stayed.
2.0 Some other applicants have retired after the order dated 07.04.2015 was stayed. Their retiral dues have been paid ignoring the letter dated 07.04.2015, but after taking an undertaking that if some recovery become due, it will be refunded.
3.0 The applicants plead that the letter dated 07.04.2015 was 26 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 subject matter of adjudication by the Chandigarh Bench of the Tribunal in OA No. 1067/2017 which was decided vide on 28.11.2019 wherein the letter dated 07.04.2015 was quashed and set aside. 4.0 The respondents plead that the decision by the Chandigarh Bench dated 28.11.2019, has since been challenged by filing petition before the Hon'ble High Court of Punjab & Haryana by the respondents vide Diary No. 3657091 on 02.03.2020.
5.0 Matter has been heard. Learned counsels Sh. M. S. Ramalingam & Sh. G. Natrajan with Sh. M. K. Bhardwaj and Ms. Kavita represent the applicants and learned counsel Sh. Rajiv R Raj represents the Respondent No. 1 and learned Ms. Madhusmita Bora represents the Respondent No. 2 & 3.
6.0 Since the pay fixation order dated 07.04.2015 has already been adjudicated and quashed and set aside by the Chandigarh Bench, the instant OA is also decided on similar grounds.
However, in respect of all such applicants who may not have been released their retiral dues, an undertaking shall be obtained from them that if as a result of adjudication by Hon'ble High Court of Punjab & Haryana, certain amounts are required to be recovered, the applicants shall pay back the same within the time period specified by the respondents. The retiral dues shall be released within eight weeks of submission of such an undertaking.
7.0 The respondent preferred the MA Nos. 3537/2012 & 3963/2019 seeking orders to release the retiral dues by doing pay fixation by honouring the order dated 07.04.2015. These MAs are also 27 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 disposed of as having become infructuous.
8.0 Accordingly, OA is disposed of with above directions. No costs.
C. OA No. 1467/2017 with MA No. 3963/2017 1.0 The applicants herein are aggrieved with the office order dated 07.04.2015 wherein the pay was reduced. Since certain applicants had already retired, certain recoveries became due. Against such recoveries, stay was granted on 21.04.2015.
2.0 The office order dated 07.04.2015 had come under adjudication in another OA No. 1974/2015 which was filed by similarly placed applicants and this was stayed on 27.05.2015. Accordingly, those who had already retired, were paid their retiral dues ignoring the letter dated 07.04.2015.
3.0 The applicant also mentioned that letter dated 07.04.2015 has since been quashed by the Chandigarh Bench of the Tribunal in OA No. 1067/2017 vide order dated 28.11.2019.
4.0 The respondents pleaded that these orders passed by the Chandigarh Bench have since been challenged by filing petition before the Hon'ble High Court of Punjab & Haryana by the respondents vide Diary No. 3657091 on 02.03.2020.
5.0 Matter has been heard. Learned proxy counsel Sh. M. K. Bhardwaj represents Sh. A. K. Trivedi, learned counsel for the applicants and Sh. Rajiv R Raj and Dr. Ch. 2483/2018, 1665/2015, 1956/2015 & 1974/2015 6.0 Since the bone of contention is the office order dated 07.04.2015 which has since been quashed and set aside by the Chandigarh Bench, the present OA is disposed of in similar terms. 7.0 The respondents are directed to release the retiral dues by ignoring office order dated 07.04.2015 and by taking an undertaking from the respective applicants that if as result of adjudication by the Hon'ble High Court of Punjab & Haryana, certain recoveries become due, the same shall be paid by the applicants within the time specified by the respondents. No costs.
8.0 The MAs preferred by the respondents, are also disposed off as having become infructuous.
D. OA No. 1665/2015 with MA No. 3925/2017 1.0 The applicants herein are aggrieved with the office order dated 07.04.2015 wherein the pay was to be reduced. Since certain applicants had already retired and retiral dues were released ignoring this order dated 07.04.2015, certain recoveries became due. Against such recoveries, stay was granted on 05.05.2015.
2.0 The office order dated 07.04.2015 came under adjudication in another OA No. 1974/2015 which was filed by similarly placed applicants and this was stayed on 27.05.2015. Accordingly, those who had already retired, were paid their retiral dues ignoring the letter dated 07.04.2015.
3.0 The applicants also mentioned that letter dated 07.04.2015 has since been quashed by the Chandigarh Bench of the Tribunal in OA No. 29 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 1067/2017 vide order dated 28.11.2019.
4.0 The respondents pleaded that these orders passed by the Chandigarh Bench have since been challenged by filing petition before the Hon'ble High Court of Punjab & Haryana by the respondents vide Diary No. 3657091 on 02.03.2020.
5.0 Matter has been heard. Learned proxy counsel Ms. Kavita represents Sh. Ashwani Bhardwaj, learned counsel for the applicants. Learned counsel Dr. Ch. Shamsuddin Khan represents the Respondent No. 1 and learned counsel Ms. Madhusmita Bora represents the Respondent No. 2 & 3.
6.0 Since the bone of contention is office order dated 07.04.2015 which has since been quashed and set aside by the Chandigarh Bench, the present OA is disposed off in similar terms. 7.0 The respondents are directed to release the retiral dues by ignoring office order dated 07.04.2015 and by taking an undertaking from the respective applicants that if as result of adjudication by the Hon'ble High Court of Punjab & Haryana, certain recoveries become due, the same shall be paid by them within the time so specified by the respondents. No costs.
8.0 MA No. 3925/2017 preferred by the respondents, is also disposed off as having become infructuous.
E. OA No. 2483/2018 with MA No. 4258/2018 1.0 The applicants were aggrieved with the downward revision of their pay fixation as was ordered on 07.04.2015. They have preferred the 30 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 instant OA. This order was stayed in respect of the applicants on 06.07.2018. Both applicants have since retired during the pendency of the OA and their retiral dues have since been released ignoring the order dated 07.04.2015.
2.0 The applicant brings out that the office order dated 07.04.2015 has since been adjudicated by the Hon'ble Chandigarh Bench of the Tribunal in OA No. 1067/2017 and was quashed and set aside vide their judgment dated 28.11.2019. The applicants plead that the instant OA can also be disposed of in similar terms. The applicant had also preferred MA No. 2777/2018 for joining together and same was allowed. 3.0 The respondents plead that the judgment by the Chandigarh Bench has since challenged by filing petition before the Hon'ble High Court of Punjab & Haryana by the respondents vide Diary No. 3657091 on 02.03.2020.
4.0 Matter has been heard. Learned counsel Sh. M. K. Bhardwaj represents the applicants and Sh. D. S. Mahendru represents the Respondent No. 1 and learned counsel Ms. Madhusmita Bora represents the Respondent No. 2 & 3.
5.0 The bone of contention which caused the grievance, was the office order dated 07.04.2015. This letter has since been quashed and set aside by the Chandigarh Bench in OA No. 1067/2017 dated 28.11.2019. Accordingly, the present OA is also disposed off in similar terms. However, the retiral dues as have already been released, shall be subject to adjudication by the Hon'ble High Court of Punjab & Haryana and recoveries if any become due, shall be paid back by the applicants within 31 OA No. 1467/2015 with OA Nos.
2483/2018, 1665/2015, 1956/2015 & 1974/2015 the time so specified by the respondents. No costs. 6.0 The MA No. 4255/2013 preferred by the respondents to correct the pay fixation as per office order dated 07.04.2015, has become infructous and same is dismissed.
