Appellant is present through Ld. Counsel.

Ld. Counsel for the appellant files a petition supported by affidavit praying for dispose off/drop of the Appeal being No. FA/66/2023 arising out of CC/104/2022 and stating that for proper adjudication of the case being No. WBRERA/COM001168 U/S 71 of RERA Act (Real Estate Regulation and Development Act, 2016) the present appeal being No. FA/66/2023 is required to be withdrawn. Considering the facts and circumstances of the case I am of the view that the grounds shown in the withdrawal petition is sufficient and accordingly the prayer is allowed. The appellant may be permitted for withdrawal of the Appeal being No. FA/66/2023. Hence, it is ORDERED That the appellant is permitted to withdraw the Appeal. The instant Appeal is thus disposed off.
All the pending applications, if any, are also disposed off accordingly. Supply free copies of this order to the contesting parties forthwith.
