1. Respondent no.1 has been proceeded against ex parte before the IPAB vide order dated 21st January, 2022.
2. Counsel for the petitioner submits that in the order dated 14th December, 2022 passed by the Joint Registrar, the appearance of Mr. Neeraj Grover, Ms. Ayushi Chandra and Ms. Sunidhi Gupta, Advocates has wrongly been noted for the respondent no.1. He has telephonically confirmed from the said counsels.
3. Today, counsel for the petitioner has handed over a fresh trade mark registration granted in favour of the respondent no.1 in respect of the logo , the device mark and the word mark Signature Not Verified Digitally Signed By:AMIT BANSAL C.O. (COMM.IPD-TM) 393/2022 Signing Page Date:16.02.2023 1 of 2 15:32:01 'ABANTE'. The same are taken on record.
4. Further, as noted in the order dated 23rd January, 2023, respondent no.1 has also changed their corporate name from 'Alpha Integrated Management Services Private Limited' to 'Abante Integrated Management Services Private Limited'.
5. In these circumstances, it is deemed appropriate to issue court notice to the respondent no.1.
6. Court notice be issued to the respondent no.1 at the following address, as shown in its trade mark application dated 28th September, 2021:
ABANTE INTEGRATED MANAGEMENT SERVICES PRIVATE LIMITED, C 301 302, 3rd Floor, M3M Urbana, Golf Course Extension Road, Sector-67, Gorgaon, Haryana 122101
7. Court notice be also issued to the attorney, BRB Legal, who applied for the aforesaid trade mark registration in favour of the respondent no.1, at the following address:
Z-29 LGF, Hauz Khas, New Delhi 110016
