ORAL ORDER
1. Learned advocate appearing for the petitioner submits that the suspicious transaction worth Rs. 50,000/- had taken place in the bank account of the petitioner and because of the same the entire bank account of the petitioner has been freezed by the investigating agency. He submitted that a circular has been issued by the Inspector General of Police, Gandhinagar, wherein it is directed that when the amount involved in the offence is less than Rs. 5 lakh, instead of freezing the entire account, the amount in question shall be kept as a lien.
2. As per these guidelines issued by the Finance Department, instead of freezing the entire account of the petitioner, the amount of Rs. 50,000/- can be kept as a lien. The petitioner herein is willing to keep the amount of Rs. 50,000/- in his account towards lien. 3. Learned APP has submitted that in view of the said guidelines, the action may be taken by the police authorities.
4. Learned advocate appearing for the bank has submitted that appropriate orders may be passed.
5. Heard learned advocate for the parties.
6. Having regard to the guidelines issued by Director General and Inspector General of Police, Gandhinagar, on 08.07.2024 in cases where the amount of fraud is less than Rs. 5,00,000/-, instead of freezing the entire account the amount in question has to be freezed. Accordingly, the amount involved in the present case is the amount of Rs. 50,000/-, which the petitioner is ready and willing to keep as a lien.
7. Having regard to these aspects, the petition stands allowed. The account of the present petitioner is ordered to be de-freezed. The amount of Rs. 50,000/- shall be kept as a lien in the account of the petitioner.
