23.

(1)Where the lessee or the licensee as the case may be, does not pay any part of the premium or ground or lease rent or fees or service charges or any other charge and the amount remains as balance, the Authority shall have power to recover penal surcharge for delayed period and to recover the balance as arrears of land revenue :Provided that if the arrears remain unpaid for three years, the Authority shall have powers to terminate the lease or the license, as the case may be, and re-enter into the property.
(2)If the lessee or licensee as the case may be does not deposit the premium or any part thereof according to terms of agreement, the Authority shall have power to terminate the lease and forfeit the amount deposited. Any amount of loss caused to the Authority shall be recoverable.
(3)If the Chief Executive Officer has sufficient reasons to determine that the lessee or the licensee, as the case may be, is unable to use the demised property for the purpose for which it is leased or licensed the amount deposited for the lease or license, after deducting service fees as the Authority may decide from time to time the balance amount shall be refunded and the lease or license shall be terminated.
