Both parties are present and heard.
CIC/YA/A/2015/002284 The appellant through his RTI application dated 24.02.2015 sought inspection of proceedings/concerned files/documents related to all policy decisions taken for appointment of Administrative Head at NPCIL Hq., Mumbai by NPCIL Board. The PIO vide letter dated
02.04.2014 furnished copies of the office orders issued by CMD, NPCIL regarding appointment of Admin.istrative Head /(Director(HR)/Executive Director (HR) in NPCIL from the year 1998 to 2003. Not satisfied with the response, the appellant filed an appeal on 09.05.2015. The FAA vide order dated 16.06.2015 upheld that reply of CPIO is in order.
CIC/CC/A/2015/002636 The appellant vide RTI application dated 01.09.2014 sought 2 point information relating to decisions taken by NPCIL Board for appointment of IAS officer asAdministrative Head (Director(HR) at NPCIL Hq. During the year 1998-2003. CPIO vide letter dated 09.10.2014 furnished reply to the appellant. Not satisfied with the response the appellant filed an appeal on 21.11.2014. The FAA upheld that reply of CPIO is in order.
The appellant states that he requested for inspection of proceedings/concerned files related to all policy decisions taken in connection with appointment of Administrative Head at NPCIL Hq. Mumbai. He further states that an IAS officer was appointed as the Administrative Head at the NPCIL Hq. Mumbai and there must have been some deliberations in the Board prior to his appointment. He further alleged that CPIO provided the wrong and misleading statement with an intention to hide the required information. The CPIO states that appellant has already been informed that there is no such record of proceedings related to policy decisions taken by the NPCIL Board with regard to appointment of Administrative Head, NPCIL during the period 1998-2003. A copy of the available documents i.e. office orders issued by CMD, NPCIL during the year 1998-2003 was provided to the appellant and there is no additional information regarding policy decisions taken by NPCIL Board related to appointment of Administrative Head, Director(HR)/Executive Director. He further certifies on oath before the Commission that there is no such record of proceedings available in the NPCIL.
Decision:
After hearing parties and on perusal of record, the Commission the Commission finds in both the above mentioned appeals, information as available on record has already been furnished to the appellant and no further action is required in the matter.
The appeals are disposed of accordingly.
