               CRIMINAL PETITION NO.524 of 2020

ORDER:

This Criminal Petition is filed by the petitioner/Accused, under Section 482 of Criminal Procedure Code,1973 (for short 'Cr.P.C'), seeking to quash the proceedings in Crime No.168 of 2019 of Eluru Town police station, West Godavari District, registered for the offences punishable under Sections 328, 270, 273 of Indian Penal Code, 1860 (for short 'I.P.C') and Section 22 of The Cigarettes and Other Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (for short 'COTPA Act').

When the matter is taken up for hearing, it is brought to the notice of this Court that in batch of Criminal Petitions, filed to quash the proceedings registered for the offences under Indian Penal Code and Food Safety and Standards Act,2006, are allowed by this Court, vide Order, dated 27.08.2018 in Criminal Petition No.3731 of 2018 and batch.

The case on hand has also been filed questioning the proceedings in F.I.R registered for the offence of possessing Gutka packets.

Following the order passed in the aforementioned batch of Criminal Petitions, and for the reasons recorded therein, this Criminal Petition is allowed, quashing the proceedings in Crime No.168 of 2019 of Eluru Town police station, West Godavari 2 registered for the offences punishable under Sections 328, 270, 273 of I.P.C and Section 22 of the COTPA Act as against the petitioner.

Consequently, miscellaneous petitions pending, if any, in the Criminal Petition shall stand closed.
