By filing the present petition under Section 482 of the Code of Criminal Procedure, the petitioner has sought quashing of the order dated 24.5.2012 (Annexure P-2), passed by the learned Sessions Judge, Kapurthala whereby the petitioner and other co-accused have been summoned under Section 319 of Cr.P.C., to face the trial in a complaint case No.40 dated 30.4.2004, titled as "Harbans Singh vs. Gurvinder Singh and others", as an additional accused.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. Paramjit Singh died due to electric shocks. She further submits that nothing is to be recovered from the petitioner.

Complainant Harbans Singh PW2 in his statement has specifically named all the 14 accused persons including the present CRM No.M-25727 of 2012 2 petitioner, who were involved in the commission of murder of Paramjit Singh, who was one of the witnesses in a complain case filed by him, and the accused were pressurising him not to depose against them. Out of 14 accused, four are already facing the trial. There is no material on record to show that the petitioner was not involved in the crime. Therefore, no case is made out to set aside the impugned order. Accordingly, the present petition being devoid of any merit is dismissed.
