(HON'BLE DR. K.B. SURESH, MEMBER (J) It is most unfortunate that some department adopt all sort of unnecessary tactics to confuse the situation. We had passed an earlier order after considering all the matters in issue and after hearing the learned counsels in detail.
2. Now the issue posited is in a very small compass. The ground taken by the Hon'ble High Court seems to be that we had not considered the elements of evidence available to ascertain the working hours of the applicant.
3. Therefore we have considered Annexure-A2 and quote from it:
"DEPARTMENT OF POSTS INSPECTION REPORT ON JAKANUR BO, A/W BADAMI MDG UNDER BAGALKOT HO BY INPSECTOR POSTS, BADAMI SUB 3 OA.No.170/01289/2015/CAT/BANGALORE DIVISION BADAMI - 587 201, ON 4-11-2008 INTRODUCTION Visited JAKANUR BO in account with Badami MDG at 1000 hrs. on 4-11-08 and stayed there up to 1600 hrs for carrying out its annual inspection. Shri R.B. GADAGKAR, then IP Badami has carried out the last inspection on 10-8-2007. Shri R.M. Chanagoudar, Mail Overseer No. 1 of this sub division has visited this office on 1-11- 2007, and has issued the visit report, which is on record in this office. Name of the Shri R.P. 1. The establishment of this BO comprises of;
a) GDS BPM/DP-1 Note please: Mr. R.P. Udupi, the working BPM states that, he was GDS MD/MC Jakanur BO and on death of regular incumbent since 7 years, he has been given the charge of this post. There are no orders from DO Bagalkot for this arrangement. Hon. SPOs are requested to look into the matter and do the needful.
2. The particulars of the staff as under: DOB DOA
a) Mr. R.P. Udupi 28.8.1959 2.3.1980 (as GDS MC/MD) GDS BPM stated to have given adequate security and is update. The PM Bagalkot HO will confirm this.
3. The balances worth Rs. 1249.45 (Rs. One thousand two hundred and forty nine/45 paise only) were verified with satisfactory results. (Cash Rs. Nine hundred and sixty six/paise 45 and stamps Rs. Two hundred and eighty three only) were verified with satisfactory results.

6. When all these are taken in conjunction, it is crystal clear that the entirety of the issue had been looked into and after that only an order was passed.14

7. At this point of time, the learned counsel for the respondents raises an issue that Annexure-R3 and R4 was not considered. Therefore we had taken up Annexure-R3 and R4 today and it is quoted in full:

8. But Annexure-R3 and R4 are not of the combined duty but only one 16 OA.No.170/01289/2015/CAT/BANGALORE part of the duty. Therefore what they have stated in the Hon'ble High Court of Karnataka at Dharwad seems to be absolutely falsehood and wrong and they have mislead the Court into passing an order. Anyhow it is a common knowledge that a person cannot deliver mail for 22 kms without at least having 3 hours time. His normal duty as a BPM is more than 5 hours therefore any reasonable man can assume and presume that more than 8 hours would have been spent by him in his work and it has been consistently granted to him. Just because some new wisdom has dawned on the respondents it does not enure to the prejudice of the applicant. We find that the respondents have acted most irresponsibly and have also in a way conducted a judicial fraud by suppressing valid materials as Annexure-
A2, A3 and A4 are their own creation and Annexure-R3 and R4 has nothing to do with the matter as they are concerned only with one element of employment and not the second element of the employment. They have raised a frivolous and vexatious reasoning to delay the grant of benefit to the applicant.
9. The OA is therefore allowed as above. All the benefits as ascribed in the earlier order will be available to the applicant. The OA is allowed with a cost of Rs.5000/-.17
