1. INTRODUCTION 1.1 This batch of Regular First Appeals as well as a cross-objection (details whereof are on the foot of the judgment), filed under Section 74 of the Right to Fair Compensation and Transparency in Land Acquisition, rehabilitation and Resettlement Act, 2013 (hereinafter referred to as 'the 2013 Act) assail the correctness of the awards passed by the Authority (hereinafter referred as Reference Court) on 21.01.2019, 10.05.2019, 13.08.2019 and 05.09.2019. The notifications under Sections 4 and 6 of the Land Acquisition Act, 1894 (hereinafter referred to as 'the 1894 Act), are common. By two different awards i.e. award No.8 and 10 dated 04.07.2014, the Land Acquisition Collector (hereinafter referred to as 'the LAC') has assessed the identical market value of the acquired land. The Reference Court/Authority has uniformly assessed the market value of the acquired land at the rate of Rs.72,00,000/- per acre. The learned counsel representing the parties are ad idem that this bunch of appeals and a cross-objection bearing No.XOBJR-154-2019, can be decided by a common judgment.

1.2 The relevant particulars of the cases are:-

 4. 21.01.2019,     10.05.2019, The Reference Court/Authority has

1.3         It is evident that the present cases relate to a transitional period

between the 1894 Act and the 2013 Act. Hence, these case are governed by Section 24 (1) (a) of the 2013 Act. It provides that for the purpose of the assessing compensation, the provisions of the Act of 2013 shall apply.

1.4 The landowners claim that the acquired land has an immense potential to be used for the residential, commercial and industrial purposes.

It has been pointed out that the acquired land is not only located near the already established special economic zone but is also close to the national highway. It is claimed that the market value of the acquired land is not less than Rs.25,000/- per square yard. The State contests the aforesaid position and submits that the award passed by the LAC is made in accordance with the law.

1.5 It may be noted here that vide award dated 21.01.2019, the RC decided as many as 62 cases. In the remaining awards passed on 10.05.2019, 13.08.2019 and 05.09.2019, by the RC, the reliance has been placed on the award dated 21.01.2019.

2. ORAL AND DOCUMENTARY EVIDENCE 2.1 The landowners in order to prove that the assessment made by the LAC is not correct, have examined PW-1 Bharat Singh as well PW-1 Ramesh Chander (He has been wrongly numbered as PW-1, in the RC.

2.2 Apart from the above-mentioned oral evidence, the landowners have produced the following sale deeds which have been compiled in a table by the RC:-

2.3              Per contra, the State examined Sh. Ajay Mann, Patwari, from

the Office of Land Acquisition Collector, Urban Estate, Rohtak and produced the following documentary evidence:

2.4              It is evident from the reading of the judgment passed by the RC

that it failed to discuss the oral and documentary evidence produced by the State of Haryana while determining/deciding the case.

3. REASONS AND ANALYSIS OF THE AWARD GIVEN BY THE REFERENCE COURT:-

3.1 It may be noted here that the landowners have also relied upon the previous award of the RC in Kamdhenu Builteck Pvt. Ltd. Vs. State of Haryana, with respect to acquisition of land for developing Sector 7, Jhajjar. The aforesaid award has been exhibited as Ex.P-76. The sale deeds Ex.P-1 to P-74 except P-8 to P-16, have already been noticed and considered by the Court in the award Ex.P-76. The RC has found that the sale instances Ex.P-8 to Ex.P-16, are with respect to significantly small 6 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -7-

other connected cases sized plots. The RC found that the market value is to be assessed as on 01.01.2014 i.e. the date of enforcement of 2013 Act. The Court in that regard relies upon the judgment passed by the Division Bench of the Allahabad High Court in Writ (Civil) No.60276 of 2015, titled as "Ishan International Educational Society through Director Vs. State of Uttar Pradesh and others", decided on 09.05.2017. The landowners also produced sale deeds Ex.P-77 and Ex.P-78. It was found that Ex.P-78 is with respect to a very small parcel of land, whereas, Ex.P-77, dated 22.11.2015, is with respect to 59 kanals and 16 marlas of land which has been sold at the rate of Rupees One Crore Twenty Lakh per acre. The Court after finding that no layout plan to compare the location of the parcel of land sold through Ex.P-77, with the acquired land, has been produced, discounted the price by 40% to arrive at a figure of Rs.72,00,000/- per acre.

4. ARGUMENTS MADE BY THE LEARNED COUNSELS REPRESENTING THE PARTIES:-

4.1 This Bench has heard the learned counsel representing the parties at length and with their able assistance perused the paperbook.
4.2 The learned counsel representing the landowners contend that the RC has erred in assessing the market value without examining Section 26 of the 2013 Act. While elaborating, the learned counsel has drawn the attention of the Court to Section 26 of the 2013 Act, which provides that the LAC is required to determine the average sale price on the basis of one half of the total number of sale deeds or registered agreements to sell in which the highest price has been reflected. It is contended that the RC committed an error in refusing to take into account one half of the total number of the sale deed produced by the landowners in which the highest sale price has been reflected. other connected cases market value by a factor to be specified in the first Schedule of the 2013 Act.

4.3 Per contra, the learned counsel representing the State has submitted that RC has committed an error in ignoring the sale deeds produced by it. It has been submitted that the entire approach of the Reference Court while deciding the case was wrong particularly when the RC failed to correctly interpret Section 26 read with first Schedule of the 2013 Act.

5. DISCUSSION BY THIS COURT 5.1 The issue of assessment of the market value as on 01.01.2014, i.e. the date of enforcement of 2013 Act has been discussed in detail in Regular First Appeal No.309 of 2021, titled as "State of Haryana and another Vs. Rajbir and another", decided on 19.04.2022. After culling out the following issues, the matter has been analysed in an elaborate manner.

For brevity the same is extracted as under:-

"1) In the present RFA, the following questions need deliberation:-
(1) With respect to acquisition of immovable property during transitional period between the Land Acquisition Act, 1894 ( hereinafter referred to as the 1894 Act) and The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013(hereinafter referred to as RFCTLARR Act, 2013') regulated by Section 24(1)(a), whether the crucial date for the assessment of the market value is the date of enforcement of the Act i.e. 01.01.2014 or the date of publication of notification u/s 4(1) of the 1894 Act?
(2). Whether the date from which the additional amount payable U/s 30(3) of RFCTLARR Act, 2013 @ 12% P.A. is to be calculated shall be 8 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -9-

other connected cases 01.01.2014 or the date on which notification U/s 4(1) of the 1894 was published?

(3). Whether the letter/communication dated 26.10.2015 is in the nature of directions issued by the Central Government in exercise of power u/s 113 of the RFCTLARR Act, 2013?

If the answer to question (3) is in affirmative, then, the next question which would require elaboration is:-

(4) Whether during the transitional period, the communication dated 26.10.2015 shall supplant the provisions of the RFCTLARR Act, 2013?

6. The RFCTLARR Act, 2013 has come into force with effect from 1st day of January, 2014. On a careful reading of sub-section(1) of Section 26 of the RFCTLARR Act, 2013, it is evident that the Collector is required to determine the market value of the acquired land after analyzing the cases on the basis of following three criterias:-

(a) On the basis of instructions issued under Indian Stamp Act, 1899 for registration of sale deeds or registered agreements to sell in the area where the acquired land is situated; or
(b) The average sale price for similar type of land situated in the nearest village or nearest vicinity area; or
(c) Consented amount of compensation as agreed upon under sub-section(2) of Section 2 of the RFCTLARR Act, 2013 in case of acquisition of land for private companies or for public private partnership projects.

7. It is further provided that the Collector is required to adopt the method which assesses the highest market value out of the three options as provided under Clause(a), (b) and (c) of sub-section(1) of Section 26 of the RFCTLARR Act, 2013. The proviso to Section 26 (1) lays down that the market value shall be determined on the date on which the notification under Section 11 of the RFCTLARR Act, 2013 was issued. Explanation-1 to Section 26(1) provides that for determining the market value under Clause (b), the average sale price is required to be assessed by taking into account the sale deeds or the agreements to sell registered for similar type of area in the nearby village or nearby vicinity area during the period immediately preceding three years of 9 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -10- other connected cases the year in which the notification under Section 4(2) of the RFCTLARR Act, 2013, for proposed acquisition of the land was issued. Thus, there is a substantial difference between the assessment under the old Act and under the new Act. In the RFCTLARR Act, 2013, the average sale price is calculated on the basis of the sale deeds or registered agreements to sell with respect to the period three years preceding the year in which such acquisition is proposed to be made. It is provided that the sale deeds of the year in which the notification under Section 4(2) of the RFCTLARR Act, 2013 has been issued shall be required to be excluded.

8. Similarly, Explanation-2 provides that while determining the average sale price, one half of the total number of the sale deeds or the agreements to sell in which the highest sale price has been reflected shall be taken into account. Explanation-3 stipulates that any price paid as compensation for the land acquired under the provisions of the RFCTLARR Act, 2013 on an earlier occasion in the district shall not be taken into consideration. In other words, the previous assessment of the market value either by the Land Acquisition Collector or the Court with respect to different parcel of land by a separate notification shall be excluded from consideration while assessing the market value of the acquired land. Thereafter, Explanation-4 provides that if the Collector is of the opinion that any price paid or allegedly paid is not indicative of the prevailing market value, then, such sale deed(s) may be discarded for the purposes of calculating market value or in other words, excluded from being considered while calculating the average sale price. Further, sub-section(2) of Section 26 provides that after calculating the market value as per sub-section (1), the Collector shall multiply the same by a factor to be specified in the first schedule. Sub- section(3) further provides that where the Collector is unable to determine the market value of the acquired land under sub-section(1) or sub-section (2), then, the State Government shall specify the floor rate or minimum price per unit of the said land on the price calculated in the manner specified in sub-section (1) in respect of similar types of land situated in the immediately adjoining areas. Moreover, the various provisos to sub-section (3) provide the procedure where the acquiring body offers its shares to the owners. The last proviso to sub-section (3) provides that it shall be the duty of the appropriate government to ensure that the market value determined for acquisition of any land or property of the educational institution established or administered by a religious or linguistic minority shall be such as would not restrict or abrogate the right to establish and administer educational institutions of their 10 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -11- other connected cases choice.

9. Section 28 of the RFCTLARR Act, 2013 lays down the various parameters to be kept in mind by the Collector while assessing the market value. Section 30 provides that the Collector after having assessed the compensation to be paid as per Section 26 (1 and 2) (including value of things attached to land or building), shall award a solatium amount equivalent to 100% of the compensation amount. It is significant to note that the amount of solatium is required to be calculated on the compensation amount which includes the determination made by the Collector in accordance with Section 26(1), (2) and (3) of the RFCTLARR Act, 2013, as the case may be. On a careful reading of Section 27, it is evident that the Collector is required to calculate the total amount of compensation including the market value of all the assets attached to the land. Sub-section (3) of Section 30 provides that the Collector shall, in every case, award an amount calculated at the rate of twelve per cent per annum on such market value for the period commencing on and from the date of publication of the notification for conducting Social Impact Assessment study of the land proposed to be acquired under sub- section (2) of section 4 of the RFCTLARR Act, 2013, till the date of the award of the Collector or the date of taking possession of the land, whichever is earlier. However, there is an anomaly in the RFCTLARR Act, 2013. Under Section 69, the aforesaid interest is required to be calculated from the date of notification under Section 11 of the RFCTLARR Act, 2013, whereas Section 30(3) provides that the interest/additional amount shall be calculated from the date of notification under Section 4(2) of the 2013 Act.

10. On a careful reading of Section 30 of the RFCTLARR Act, 2013, it is evident that a Statute has used the expression "the total compensation"

determined by the Collector. Whereas Section 26(1) of the RFCTLARR Act, 2013 uses the expression 'the market value". Similarly, sub-Section (2) of Section 26 uses the expression "the market value calculated as per sub-section (1) shall be multiplied by a factor to be specified in the First Schedule. The market value assessed by the Collector under sub-section (1) of Section 26 is different from the total compensation referred to in Section 30. Obviously, it would not only include the market value but also the amount which has been arrived at after multiplying the market value by a factor to be specified in the first schedule and the value of the things attached to the earth or building. On a careful reading of the first schedule, it is evident that the statute has used the expression "compensation". The components of the minimum compensation have been

11 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -12- other connected cases specified which include not only the market value of the land, factor and the value of the assets attached to the land or the building. This fact is further clear from Sr. No.5 in the first schedule which provides for solatium. It provides that the amount of solatium shall be equivalent to 100% of the market value of land mentioned against Sr.No.1 multiplied by the factor specified against Sr. No.2 or Sr. No.3 as the case may be. The solatium is required to be awarded after including the value of assets attached to the land or the building.

30. While answering the question No.1, it is declared that under Section 24(1)(a) during the transitional period, the market value will have to be assessed on the date of publication of notification under Section 4(1) of the 1894 Act. Similarly, the additional amount under Section 30(3) of the RFCTLARR Act, 2013 shall be calculated from the date of publication of notification under Section 4 of the 1894 Act till the date of the award or date of taking possession of the land, whichever is earlier.

38. From the aforesaid discussion, the conclusion is inevitable that , with greatest respect, none of the judgments as a ratio decidendi lay down that the letter dated 26.10.2015 is, in fact, an order or direction of the Central Government in the exercise of powers under Section 113 in order to remove difficulties. The observations made by the U.P High Court in any particular judgment, cannot be considered as ratio decidendi to be applied in the other judgments. In the alternative, even if it is so, then, in the humble opinion of the Court, such communication being inconsistent with the substantive provision as well as the procedural requirements for issuing them as provided under the relevant Acts is liable to be ignored. It is well settled that after the Constitution of India, a Statute enacted by the Parliament is supreme. The rules, regulations, policy decisions, instructions and executive instructions, all from a part of subordinate/delegated legislation and therefore, they cannot supersede the statutory Act."

5.2 In view of the aforesaid discussion, it is evident that the RC has committed more than one error while deciding the said matter. The first error is to assess the market value as 01.01.2014, which has already been noticed. The RC has also not understood the true import and interpretation of Section 26 read with the first Schedule of the 2013 Act. In Sub-Section 1 12 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -13- other connected cases of Section 26, it is provided that the Collector at the first instance assesses and determine the market value of the land under the three different options available for the assessment. After taking into account the highest price, the Court shall proceed to adjudicate upon the same. As per the explanation 1, the average sale price shall be assessed while taking into account the sale deeds or agreement to sell registered for the similar parcels of land in the near village or the vicinity area during immediately preceding three years of the year in which such acquisition is proposed to be made. It is evident from the explanation 1, that the sale deeds of 2011, the year in which the notification under Section 4 of the 1894 Act was issued are required to be excluded from consideration. As per Sub-Section 2 for determining the average sale price, one half of the total number of the sale deeds or agreement to sell reflecting the highest price shall be required to be taken into an account.

5.3 Explanation 3 provides that while determining the market value, the amount assessed by the Court on an earlier occasion shall not be taken into consideration.

5.4 Explanation 4 permits the Reference Court/Authority to discard the sale deeds which do not reflect the correct market value, i.e. sale deeds which do not indicate the actual prevailing market value.

5.5 Sub-Section 2 then mandates that the market value as assessed under Section 26(1) shall be multiplied by a factor as specified in the first Schedule. The RC has not performed the said multiplication. The RC has also erred in ignoring the sale instances produced by the State. It may be noted here that the State had produced the various sale deed/exemplars. As already noticed, the RC has not even discussed the sale deeds produced by 13 of 25 ::: Downloaded on - 24-07-2022 12:47:11 ::: RFA-3175-2019 (O&M) and -14- other connected cases the State.

5.6 The 2013 Act has been enforced w.e.f. 2014 and the cases have started arising therefrom, therefore, it appears that the RC failed to take notice of the provisions of the Act in a proper perspective either due to lack of proper assistance or otherwise.

6. DECISION 6.1 Keeping in view the aforesaid facts, the awards dated 21.01.2019, 10.05.2019, 13.08.2019, and 05.09.2019, are set aside while remitting the cases back to the RC/Authority to decide afresh, after grant of opportunity to both the parties to lead further evidence, if any. The parties through their counsel are directed to appear before the RC on 25.05.2022.

The RC is requested to dispose of the matter within a period of six months, from today.

6.2 All the pending miscellaneous applications, if any, are also disposed of.
