JUDGMENT
This writ petition is filed seeking the following reliefs:
i) issue a writ of mandamus and/or other appropriate writ, order or direction, commanding the respondents 1 to 4 to implement Exhibit P4. Notice No.H4/20925/17 dated 05.10.2017 issued by the 3rd respondent, Deputy Director of Education, to close down the 6th respondent school immediately, so that the students now studying in the 6 th respondent school can be accommodated in the nearby schools during the next academic year, 2020-2021.
ii) Issue a writ of mandamus and/or other appropriate writ, order or direction, commanding the 5th respondent to implement Exhibit P1 Order No.FCPI-1148/15 dated 01.03.2016 issued by the Secretary of the 5th respondent, Corporation of Kochi to demolish the unauthorised constructions of the 2 nd and 3rd floors made in residential buildings bearing numbers XV/261 A (New No.24/1179) and XV/261 A(1) (New No.24/1179 A).
iii) Issue a writ of mandamus and/or other appropriate writ, order or direction, commanding the 3rd respondent to consider and pass order in Exhibit P11 complaint dated 26.06.2019 submitted by the petitioner in accordance with law within a period stipulated by this Hon'ble Court.
2. Heard the learned counsel for the petitioner, the learned counsel appearing for respondents 6 to 10, the learned Government Pleader and the learned counsel appearing for the CBSE. W.P.(C).No.31951/19 4

The learned counsel for the petitioner submits that respondents 7 to 10 are illegally conducting the 6th respondent school, stated to be with the CBSE syllabus, next to the residence of the petitioner. It is submitted that the school is being conducted in two residential buildings making illegal constructions on the upper floors without required space, building, teachers, staff or other facilities and violating the provisions of law. It is submitted that the Secretary, Corporation of Kochi had issued Ext.P1 order directing demolition of the unauthorized constructions. Though the respondents submitted application for regularization of the unauthorized constructions, the same has been rejected by Ext.P2 order. It is submitted that the school is being conducted in violation of Section 18 of the Right of Children to Free and Compulsory Education Act, 2009 and the 3 rd respondent, by Ext.P4, had ordered the closure of the school. Since the applications for NOC had been rejected by Ext.P7 order, the respondents have no manner of right or authority to continue the conduct of the school. It is submitted that in spite of all these orders, the school is being conducted without any legal sanction in the property in question. The learned counsel for the petitioner, therefore, submits that the writ petition is liable to be allowed and the respondents are to be directed to comply with Ext.P4 notice and to close down the school. A counter affidavit has been filed by the 3 rd respondent stating that the school has no permission or NOC from the educational authorities and that the school is not affiliated to the CBSE and does not have any approval. It is stated that notice for closing down the school had been issued by the 3rd respondent as early as on 05.10.2017. It is stated that some of the schools with CBSE syllabus which did not have affiliation and approval had approached this Court and obtained stay orders, but the 6 th respondent school has not obtained any such order. It is stated that there are sufficient schools in the vicinity and the closing down of the school will not have any impact on the children studying there.
5. A detailed counter affidavit has been placed on record by respondents 6 to 10. A series of documents to show that there was a dispute between the writ petitioner and respondents 6 to 10 have been produced along with the counter affidavit. It is also submitted that Ext.R9 (36) indemnity bond along with an application for regularization has been submitted before the 5th respondent and Ext.R9(40) would show that the school has been included in the National Scholarship Portal of the CBSE. It is submitted that the school is being run only upto 7 th standard and that the attempt of the petitioner is only to close down the school by any method. It is further submitted that application for recognition have been W.P.(C).No.31951/19 6 submitted by the school which are liable to be considered by the Educational authorities. Serious personal allegations are raised as to the conduct of the petitioner in this writ petition as well.
6. A statement has been filed by the Standing Counsel for additional respondents 11 and 12 in the writ petition. It is contended that the 6 th respondent school does not have any affiliation with the CBSE and that any contention to the contrary is denied. It is submitted that this Court by Ext.R11(a) judgment in W.A No.403/2020 has directed the CBSE to ensure that the practice of permitting students of unaffiliated schools to write examinations through affiliated schools should not be permitted. It is further submitted that steps had been taken by the CBSE to see that students and the general public are not duped by unaffiliated and unrecognized schools. It is stated that parents are provided facilities to access the CBSE affiliation website and the details of disaffiliated schools are also provided therein. Public notices in this regard have also been issued. It is submitted that for affiliation to the Board, prior recognition from the State Government is a mandatory requirement. It is, therefore, contended that, in the light of the provisions of the RTE Act, it is the responsibility of the State Government to see that no school functions without obtaining recognition. It is further submitted by the learned W.P.(C).No.31951/19 7 standing counsel appearing for the CBSE that the CBSE affiliation is relevant only from standard 8th onwards.

A reply affidavit has also been placed on record by the petitioner refuting the allegations made by respondents 6 to 10 and contending that the respondents have not controverted the valid contentions raised by the petitioner that the school does not have recognition and that there is no infrastructure available for the conduct of the school in the premises.
8. I have considered the contentions advanced at considerable length. It is apparent that the school is being conducted in a small plot of land which houses two residential buildings. It is clear that a building which houses a school where classes 1 to 7 are functional has to have atleast the minimum required facilities for the safe conduct of such an institution. The health of the students who are attending the school is a public responsibility.
9. Section 18 of the Right of Children to Free and Compulsory Education Act, 2009 reads as follows:-
"18. No school to be established without obtaining certificate of recognition.(1) No school, other than a school established, owned or controlled by 1e appropriate Government or the local authority, shall, after the commencement of this ict, be established or function, without W.P.(C).No.31951/19 8 obtaining a certificate of recognition from such uthority, by making an application in such form and manner, as may be prescribed. (2) The authority prescribed under sub-section (1) shall issue the certificate of ecognition in such form, within such period, in such manner, and subject to such conditions, is may be prescribed:
Provided that no such recognition shall be granted to a school unless it fulfils norms and standards specified under Section 19. (3) On the contravention of the conditions of recognition, the prescribed authority shall, by an order in writing, withdraw recognition:
Provided that such order shall contain a direction as to which of the neighbourhood school, the children studying in the derecognised school, shall be admitted.
Provided further that no recognition shall be so withdrawn without giving an opportunity of being heard to such school, in such manner, as may be prescribed.
(4) With effect from the date of withdrawal of the recognition under sub-section (3), no such school shall continue to function. (5) Any person who establishes or runs a school without obtaining certificate of recognition, or continues to run a school after withdrawal of recognition, shall be liable to fine which may extend to one lakh rupees and in case of continuing contraventions, to a fine of ten thousand rupees for each day during which such contravention continues."
10. The Schedule to the Act provides the norms which have to be fulfilled in terms of Sections 19 and 25 before recognition can be granted. Clause 2 of the Schedule provides the specification for the buildings and playground required for a school. The maintenance of adequate pupil- teacher ratio and other facilities are also provided in the schedule. W.P.(C).No.31951/19 9
11. Bye law 7 of the Examination bye laws of the CBSE reads as follows:-
"7. Admission : Specific Requirements 7.1 (i) Admissions upto Class VIII (i.e. Class VIII and below) shall be regulated by the rules, regulations, orders of the State/U.T. Governments applicable to the place where the School is located. (ii) Every child completing his elementary education shall be awarded a certificate, in such form and in such manner, as may be prescribed by the respective school(s) as stipulated in Section 30(2) of THE RIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION ACT, 2009.
7.2 Admission to Class IX in a school shall be open only to such a student who has passed class VIII examination from an Institution affiliated to this Board or to any recognised Board or is recognised by the Education Department of the Government of the State/U. T. in which such an institution is located.
7.3 Admission to Class X: - As the syllabus prescribed at Secondary level is of two years integrated course, no admission shall be taken in Class X directly. Provided further that admission to class X in a school shall be open only to such a student who:
a) has completed a regular course of study for Class IX from an institution affiliated to this Board;
b) has passed class IX examination from an institution affiliated to this Board.
c) A student who has completed a regular course of study for Class IX examination from an institution recognised by/ affiliated to any recognized Board in India, other than this Board, can be admitted to a school only on the transfer of the parent(s) or shifting of their families W.P.(C).No.31951/19 10 from one place to another, after procuring from the studens the marksheet and the transfer certificate duly countersigned by the educational authorities of the Board concerned. In case of all such admissions the schools would obtain post facto approval of the Board within one month of admission of the student.
*7.4 Admission to Class XI Admission to Class XI in a school shall be open to such a student who has passed:
(a) Secondary School Examination (Class X examination) conducted by this Board or
(b) an equivalent examination conducted by any other recognized Board of Secondary Education/Indian University and recognized by this Board as equivalent to its secondary school examination.
7.5 Admission to Class XII:-
i) No admission shall be taken in Class XII directly. Provided further that admission to Class XII in a school shall be open only to such a student who:
(a) has completed a regular course of study for class XI; and
(b) has passed Class XI examination from a school affiliated to this Board.
(ii) A student who has completed a regular course of study for Class XI and has passed Class XI Examination from an institution recognised by / affiliated to any recognised Board in India, other than this Board, can be admitted to a school only on the transfer of the parent(s) or shifting of their families from one place to another, after procuring from the student the marksheet and the Transfer Certificate duly countersigned by the Educational Authorities of the Board concerned. In case of such admissions the schools would obtain post facto approval of the Board within one month of the admission of the student.W.P.(C).No.31951/19 11
7.6 Notwithstanding any thing contained in paras 1 to 5 of this Byelaws, the admission of students passing qualifying examination from an examining body outside India shall be regulated according to the provisions contained in byelaw 6.2 of this chapter; provided that the condition of completing regular course of study for class IX and XI is satisfied in cases of admission to Class X and Class XII respectively. "
12. In the above view of the matter, in the light of the specific documents which are produced in the writ petition which would show that the school has no prior recognition nor affiliation, the respondents are bound to take appropriate action in pursuance of the orders passed.
The decisions of this Court with regard to the functioning of the school under the CBSE syllabus would also be applicable only in case of those schools which are functioning with the minimum required infrastructure and facilities so that the functioning of the school would not cause danger to the life and health of the students. In spite of a detailed counter affidavit having been filed by respondents 6 to 10, it is not in dispute that the school has no recognition or affiliation whatsoever. The very documents produced by respondents 6 to 10 would show that the petitioner had been making attempts to complain about the illegal functioning of the school and that the petitioner and the respondents were on inimical terms apparently due to this very reason. A Division W.P.(C).No.31951/19 12 Bench of this Court in Central Board of Secondary Education (CBSE) and Another v. V.M. Public School, Perumattom and others (2019 (3) KHC 338), this Court has considered the necessity of proper infrastructure and affiliation for enabling schools to present students for the Board examinations conducted by the CBSE. The Full Bench of this Court in Manager Aysha L.P.School and another v. State of Kerala and others [2019(3) KHC 871] has held that even a recognised school imparting elementary education loses its recognition unless it fulfils the norms and conditions specified in the RTE Act and the Schedule thereto.
In Manager Dynamic English Medium School and others v. State and others [2018 (3) KLT 521], it was held that all schools require recognition under the RTE Act. The party respondents have no case that they have obtained any recognition from the State Government under Section 18 of the RTE Act.
13. In view of the fact that the school has no proper building permit for the modifications made to the building, nor any recognition or No Objection from the State Government or affiliation to the CBSE, I am of the clear opinion that the party respondents cannot be permitted to conduct the school without any recognition or permission from any authority.W.P.(C).No.31951/19 13
14. I find no interdiction contained in any of the judgments including Ext.P38 against taking appropriate steps against unrecognised institution. In the above view of the matter, the writ petition is liable to be allowed. There will be a direction to the respondents to take appropriate action pursuant to Ext.P4. Orders shall be passed within a period of three months from the date of receipt of a copy of this judgment.
This writ petition is ordered accordingly.
