As per the office report, the service of notice of alternative arrangement is not complete n the sole petitioner and the reason assigned is “addressee absent-intimation served”.

Learned counsel for the respondent No.1 submits that the petitioner is purposely avoiding the service of notice and there is an interim order passed in favour of the petitioner. Learned counsel for the respondent No.1 further submits that an execution proceeding of FDP No. 163 of 2011 is Reason: pending before the Court of XVIII Additional City Civil & Sessions Judge-CCH-10, Bengaluru and in this proceeding, the petitioner is being represented by the counsel of his choice.
