The petitioners, who are stated to be in custody since 24.12.2010, had applied for bail before the learned Special Judge, CRM-M-20589-2011 (O&M) [7] and other connected cases :::::::::::
Ludhiana which was declined by him on 06.06.2011 on the ground that they have failed to produce any license or permit and recovery is of commercial quantity of contraband.
3. CRM-M-20407-2011 The allegations contained in the FIR are that the petitioner was found standing on a Bajaj Chetak scooter near village Sangatpura and a plastic bag was lying at his feet on the scooter. He tried to run away but was overpowered and around 100 small plastic bags and `7,000/- were recovered. The plastic bag was containing white coloured powder which was found to be 7 Kgs. 980 gms. The sample was sent for chemical analysis and it was found to have contained 64.67% Paracetamol-n and 3.945% Dextropropoxyphene-Hcl.
4. CRM-M-19588-2011 The allegations contained in the FIR are that the petitioner was seen coming from Samana side holding a bag in his right hand. On seeing the police party, he tried to run away but was apprehended at the spot. A white coloured narcotic powder was found in his bag which was found to be 2 Kg. The sample was sent for chemical analysis and it was found to have contained 62.46% Paracetamol-n and 3.383% Dextropropoxyphene-Hcl.
The petitioner, who is stated to be in custody since 17.05.2011, CRM-M-20589-2011 (O&M) [8] and other connected cases :::::::::::
had applied for bail before the learned Court below on the ground that the drug containing Paracetamol-n and Dextropropoxyphene-Hcl is less than the commercial quantity, whereas the learned State Counsel relied upon the notification dated 18.11.2009 to contend that the entire powder is to be considered weighing 2 Kg. which is more than the commercial quantity. The learned Court below dismissed bail application of the petitioner vide its order dated 11.06.2011 while relying upon the notification dated 18.11.2009.
