          Section 8 of the Act gives the Directorate General of Foreign Trade powers to suspend or cancel importer-exporter code number if there is reason to believe that any person has made an export or import in a manner that is gravely prejudicial to the trade relations of India. The proposed Bill now will delete the word ‘gravely’ because to have the word ‘gravely’ in the body of the Bill makes it difficult to prove what is gravely prejudicial particularly when these issues are taken to the Court. This amendment would enable swift and exemplary action in trade dispute matters.
   

श्री विजय बहादुर सिंह (हमीरपुर): सभापति महोदय, जहां तक इस बिल का सवाल है, इसमें दो बातें खटकती है कि यह विधेयक बड़ा क्रान्तिकारी है और इसमें इप्रूवमेट आ रहा है लेकिन इस बिल में दो भंयकर खामियां हैं। पहले मैं आपका ध्यान सैक्शन-8में अमैंडमेंट हुआ है, उस ओर दिलाना चाहता हूं और एक लाईन पढ़ देता हूं “The proviso says that the Director General or any other officer authorized by him may call for the record or any other information from that person and may, after giving to that person a notice in writing informing him of the grounds on which it is proposed to suspend or cancel the Importer-exporter Code Number and after giving him a reasonable opportunity of making a representation in writing within such reasonable time as may be specified in the notice and, if that person so desires, of being heard, suspend for a period, as may be specified in the order, or cancel the Importer-exporter Code Number of that person.”             इसका मतलब यह है कि अगर इसमें इम्पोर्टर की गड़बड़ है तो उसे एक कोड नम्बर मिलता है। अगर आपने कोड नम्बर से पता किया तो मालूम हुआ कि वह गड़बड़ कर रहा है। उसे कैंसिल करने की पावर आपके पास है लेकिन यह आपका आब्लिगेशन है कि उसे आप अपार्चुनिटी देंगे, इन राइटिंग आप रीजन्स पास करेंगे और उसे कर देंगे। यहां पर तो आपने प्रिंसीपल ऑप नेचुरल जस्टिस,1888 से जो कानून आ रहा है, no person will be condemned without being heard. यह आपने बहुत अच्छा पालन किया। त के संविधान से ऑनरेबल मिनिस्टर परिचित हैं। लेकिन आपने इसका एकदम विरोधाभास कंट्राडिक्शन सैक्शन 14बी किया है। अगर सदन की अनुमति हो तो मैं उसे पढ़ दूं। सैक्शन 14बी में लिखा है -Suspension or cancellation of a licence आपने कोड नम्बर में नेचुरल जस्टिस का पालन किया। इसमें कह रहे हैं -
