98. Immediately, this takes us back to the definition of "development" in Section 2(7) of the MRTP Act. This is a very wide and inclusive definition of land and reads as follows:

"2(7) "development" with its grammatical variation means the carrying out of buildings, engineering, mining or other operations in or over or under, land or the making of any material change, in any building or land or in the use of any building or land or any material or structural change in any heritage building or its precinct and includes 12th, 13th & 16th October 2023 Prestige Estate Projects Ltd v State of Maharashtra & Ors & Connected Matters 901-oswpl-17993-2023-J+F.doc demolition of any existing building structure or erection or part of such building, structure of erection; and reclamation, redevelopment and lay-out and sub- division of any land; and "to develop" shall be construed accordingly;"
