CORAM: HONOURABLE MS JUSTICE SONIA GOKANI

                           Date : 24/03/2015

                            ORAL ORDER

1. Attention of this Court is drawn to the letter dated 20/21.1.2015. This is addressed to the present petitioner by respondent No.3 herein. It is urged by the petitioner that no decision so far has been taken with regard to deduction from the year 1980 to 2003. It is also necessary that once any decision is taken, the details be placed before this Court.

2. Learned Assistant Government Pleader Mr.Niraj Ashar submits that as per the affidavit-in-reply, for the period from 1980 to 2003, GPF was admitted and the same was deposited with Accountant General's Office by Page 1 of 2 C/SCA/17160/2014 ORDER the Agriculture and Cooperation Department and thereafter from 1.4.2003 EPF Scheme was made applicable in the case of the petitioner. However, he ensures the Court that within the period of four weeks, the decision in this respect could be taken by respondent No.2 which is a competent authority. Considering the short issue it would be necessary that respondent No.2 decides the question of deduction from the year 1980 to 2003 as letter dated 20/21.1.2015 is very apparent that no decision so far has been taken on the said issue. Once having taken the decision, within the period of four weeks, the same shall be placed before this Court for further hearing on 29.4.2015.

3. Copy of this order shall be made available to both the sides for them to pursue the matter.
