Further, by placing reliance on Section 2(16) of the Act of 1960, it is submitted that, 'Housing Society' means, "a Society, the object of which is to provide its members with open plots for housing, dwelling houses or flats; or if open plots, the dwelling houses or flats are already acquired, to provide its members common amenities and services".
13. In the instant case, as the business of the Co-operative Society, in which the suit flat is situate, is, therefore, to provide its member the open plot or dwelling houses or flats, the dispute between the parties CRA-44-16.doc touches the business of the Co-operative Society and, therefore, the Appellate Court has committed an error in holding that, the present Suit is outside the purview of Section 91 of the Act of 1960.
