On April 16th, 2012 petitioner was apprehended by the Police of Police Station Doraha while he was carrying 44 bottles of Rexcof syrup and 40 strips of Parvon Spas capsules. The same were sent to Forensic Science Laboratory, SAS Nagar Mohali and these were found containing Chlorpheniramine Maleate, Codeine Phosphate, Dextropropoxyphene Hydrochloride and Paracetamol.

Learned counsel for the petitioner has contended that the drugs recovered from the petitioner do not come under the mischief of NDPS Act. It has been also contended that the petitioner is in custody since April 16th, 2012.
