66. It is submitted, that it was during the investigation, one Crane Operator was arrested in the presence of Village Assistant, and the Crane was seized, for illegal mining in the Government poramboke lands. This information has been given to the learned Judicial Magistrate, Melur through Form - 91 on 10.08.2012. That after the registration of the case, the accused has taken away the Crane, which was used for illicit quarrying operations, and they concealed the same in a place near Ammankovilpatti, Keelavalavu. On receipt of information, the Sub Inspector of Police of the Special Team constituted inspected the place on 13.08.2012 at about 11.00 a.m., and found the vehicles, machineries, computer hard discs, and documents pertaining to the petitioner. The Sub Inspector seized those materials, and articles under a mahazar in the presence of the Tahsildar, Melur, and the Village Administrative Officer, Keelavalavu in Crime No.155 of 2012. This intimation was also sent to the learned Judicial Magistrate, Melur through Form - 91 on 14.08.2012.
67. On 13.08.2012, another Sub Inspector of Police of the Special Team conducted a search at PRP Car shed at Melur, and seized two computer hard discs in the presence of Village Assistant, and the Watchman of the concerned car shed. This information was also intimated to the learned Judicial Magistrate, Melur on 14.08.2012. On 13.08.2012 at about 06.15 hours 6 C.Ds, one hard disc, accessories and two documents were also seized under intimation to the learned Judicial Magistrate, Melur. It is admitted in the affidavit of the fourth respondent, that the premises of the petitioner was raided by the police, and incriminating materials collected. It is the stand of the fourth respondent, that the accused attempted to take away the incriminating documents through their transport service. On information, the bus in the name of PRP bearing Registration No.TN 59 AL 4713 was seized along with 13 files relating to illicit quarrying. The seizure of the documents along with bus was also intimated to the learned Judicial Magistrate, Melur. On 16.08.2012, another bus bearing Registration No. TN 63 Q 2299, which is indulged in illegal activity of taking documents was also seized under intimation to the learned Judicial Magistrate, Melur.
69. It is admitted, that vehicles were also seized, which were involved in illicit quarrying. It is submitted, that on the basis of the confessional statements, different documents and machineries were also seized under intimation to the learned Judicial Magistrate, Melur.
70. It is further submitted, that on 31.08.2012, on the directions of the Investigating Officer, the Inspector of Police, Othakadai and DCB, Madurai jointly again conducted search in the sealed administrative buildings of PRP Exports in Therkkutheru, after breaking open the seal, and seized 7 hard discs, 6 servers and its related 16 accessories from the cabin, and they have also seized two servers, 18 hard discs, 12 C.P.Us, and its related 5 items and two cell phones and 15 keys submitted by head guard of the PRP Exports from the outer side of the cabin under mahazars in the presence of Tahsildar, Melur and Revenue Inspector, Melur, after which, the administrative buildings were again sealed.
2.The respondents shall henceforth release the bank accounts and to allow the petitioner to carry on his business in accordance with law. However, it shall be the duty of the petitioners to submit fortnightly Statement of Accounts to the Investigating Officer;
3.that the order restraining the export and import by the Investigating Officer is ordered to be quashed and it is directed that the respondents shall not interfere in the export and import on valid documents by the petitioner.
4.that the seal of the administrative building be opened, after the Investigating Officer takes in possession of the documents, the computers, hard discs, etc., required for investigation. (As agreed between the parties, the petitioner is directed to depute two persons along with an expert, if so advised to be present at the administrative building on 07.11.2012 (Wednesday) at 10.00 a.m., for handing over the computers, hard discs, documents, available in the sealed building, after transferring the datas from computers and making copies of the documents, which are required for running of business). It is made clear that the petitioner will be entitled to get copies of the documents lying within the premises and permit the Investigating Officer to take away the Computers, Hard discs and other documents, which are required for the Investigation. This process shall be completed in three days and it should be completed on or before 09.11.2012 (Friday).
