Background
1. The Applicant filed an RTI application dt.1.5.12 with the PIO, Department of Revenue, GNCTD seeking certified copies of mutation order along with patwari report forms with reference to certain file nos. and khasra nos as mentioned in his RTI application On not receiving any reply from the PIo , the Applicant filed an appeal dt.8.6.12 with the Appellate Authority reiterating his request for the information.
The Appellate Authority disposed off the appeal vide his order dt.27.6.12 directing the PIO to provide the reply within two weeks time.
On not receiving any further response, the Applicant filed a second appeal dt.21.8.12 before CIC. Decision
2. During the hearing, the Appellant submitted that vide RTI application dt.1.5.12, he had sought information against three points . He then identified the information that is still required by him which included certified copies of mutation orders along with patwari reports in respect of min. no.553/9697, min No.557/9697 and min. No.344/9798. He however pointed out that he had come to know that this information is not available in the records of the Public Authority and requested the Commission to direct the Respondent to furnish hm and affidavit affirming the fact that above mentioned information is not available in the records.

The Commission accordingly directs the PIO to furnish such an affidavit to the Commission with a copy to the Appellant affirming the fact that copies of mutation orders as also patwari reports in min. no.553/9697, Min No.557/96 97 and Min. No.344/9798 are not available with the Public Authority. The affidavit should reach the Commission/Appellant within four weeks of receipt of this order.
4. The appeal is disposed off with the above directions.
