11. According to the respondents, that

Career Progression Scheme (MACP Scheme ... MACP w.e.f.
01.09.2008 was wrong as the requirement of grant of 3 rd MACP
(MACP Scheme came into effect on 01.09.2008) already stood
whether benefits of
financial upgradations under the Modified Assured Career Progression
(MACP) Scheme should be given in the next grade pay of the same ... 4800.
3.4 The applicants were granted first financial upgradation under the
MACP Scheme vide order dated 20.11.2012 in the grade pay of Rs.5400
with Grade Pay of Rs.4200/-. After the introduction of
the MACP Scheme, the applicant was granted the 2nd financial upgradation by
granting him Grade ... 4600/-
at the time of 2nd financial upgradation under the MACP Scheme. Moreover,
the recovery ordered by the respondents is unjust and unfair since
third upgradation in the Grade Pay of Rs.5400/- under
the MACP scheme has been withdrawn. They are also challenging
the order dated 29.07.2016 (Annexure ... respondents that ACP scheme is
not a time bound promotion scheme. It is a non-functional financial
upgradation scheme to deal with problem of genuine
whereby their
request for grant of 2nd financial upgradation under MACP Scheme
w.e.f. 01.09.2009 has been rejected by the respondents.
