14. Under Section 5 of the Drugs and Cosmetics Act, 1940 a “Drugs
Technical Advisory Board ... prescribed. Chapter III deals with the definition of
‘misbranded drugs’; ‘adulterated drugs’; ‘spurious drugs’; ‘misbranded
cosmetics’; ‘spurious cosmetics’ etc.
Under Section 16 , it is mandated
namely, prohibition of manufacture and sale
of certain drugs and cosmetics which are misbranded, spurious and
substituted wholly or in part by another drug ... misbranded
