Judge of this court on 16.05.2011 in respect of the rights of
oustees for allotment of plots, as part of Rehabilitation & Resettlement
Scheme ... present appeal.
The question of allotment of the plots to the oustees, came up
for consideration before the Hon'ble Supreme Court in State
rehabilitation of displaced persons. The award
defined the meaning of the land, oustee and family. The Gujarat
Government was to pay to Madhya Pradesh ... compulsory acquisition of land. Further, the
Tribunal had provided for rehabilitation of oustees and civic amenities
to be provided to the oustees. The award also
allotments where allotments had already been cancelled; and
to allot land to oustees who had not yet been allotted any.
Construction work on the Pong ... Power and the representatives of these two States, it was
agreed that oustees of the Pong Dem, the Rajasthan Feeder
and the Beas Sutlej Link
amended on 3.7.2003. The High Court direction applied even to those
oustees who had already withdrawn the compensation, if such oustees
opt for such land ... policy in 1985 (hereinafter called `R & R Policy') for the
oustees of all the Narmada projects in the State. The said policy
measures needed to ensure that the standard of living of the
oustees is not affected due to the project. The study will be completed
residential urban estate along with the proposed road, mainly to adjust
oustees of the above said road. Land acquired by the first notification ... acquisition of land for development of residential urban estate to adjust
oustees of the above said road. According to the Government, with the
acquisition
year, 1971 for rehabilitating the Bhakra Dam Oustees. For
of
the purpose of construction of Bhakra Dam, large area of the public was
acquired which ... employment and the policies
framed by the Government for rehabilitation of the Oustees were not
implemented properly.
6. Petitioners are carrying out the business
clarified by
circular dated 9.5.1990) for allotment of plots to land losers/oustees at
normal allotment rates. The said scheme inter alia provides for allotment ... every acre of land acquired. It requires that "claims of the oustees shall be
invited before the sector is floated for sale

NTPC ran into industrial relations problems as the said Land ... Oustees
demanded a larger share of preference in the employment in the various
classes of posts. Accordingly, the NTPC made adjustments to the
recruitment procedure

though the petitioners being oustees were entitled for allotment of
plots/sites in terms of the Rehabilitation ... Sandeep & others (supra), the Division
Bench determined the rights of the oustees for allotment of
plots/sites, in terms of the policies formulated
