ORDER
The petitioner purchased standing timber trees in Survey
No.186 and 187 situated at Alavalli village ... name of the petitioner was mutated as owner in
respect of standing timber on the lands in question. Respondent
No.1 purchased the said lands
before the Arbitrator is that there was an agreement to sell
standing timber between Sri.M.Ananda and respondents in

cut and remove the aforesaid standing timber. The
appellant entered into the agreement dated 6.9.2006 in
consideration ... after he had cut and removed the
standing timber. The respondent instituted a suit for
recovery of money as aforesaid contending that the
appellant
plaintiff had assured to permit them to
remove the standing timber on the schedule property free of
cost and insisted for the same. There ... sale deed to enable the defendants to take the standing
timber free of cost and it was not assured at any time. When
this
suspension order, it is seen
that an allegation, that the standing timber on

contradicted by the contents of the FIR wherein, the
agreement of sale of standing timber and the persons
responsible for doctoring
that the
accused had approached the complainant offering to
purchase the standing timber in his land in which regard
they had entered into an agreement ... wherein, it was agreed by the complainant to sell the
standing timber in his land which was stated to be 13.24
acres and the accused
forest contractor and was taking on lease
the standing timber on the lands of the third parties
(lessor) for consideration and used to cut those ... Halavalli village
approached him offering to sell the standing timber on his
land to him is also an un-denied plaint averment with
respect
