MACP and 3rd MACP granted to the petitioner, as
aforesaid, on the ground that the petitioner would
be entitled to grant of 1st ACP with ... examination is a
condition precedent for grant of the benefits of
ACP/MACP. In any view of the matter, it is
submitted that
other retiral benefits as the Petitioner
became eligible for abovementioned
ACP/MACP benefits in the light of judgment
passed in CWJC No.11595/2018 ( Rajesh ... ACP w.e.f. 15.03.2014 without considering that
the passing of departmental examination is not
essential to get the benefits of ACP/MACP.

Assured Career Progression scheme
(herein after referred to as the "ACP/MACP scheme"). It is also
prayed that in case recovery has already ... presumption that the petitioners have wrongly been
granted the benefits of ACP/MACP scheme, from the specified
dates, inasmuch as they had already been granted

scheme is not being considered, inasmuch as the

respectively. The petitioner was then granted benefit of 3 rd ACP /
MACP, vide letter dated 21.5.2015, with effect from 29.8.2011.
It is also stated that ... whereunder the earlier orders, granting
the benefits of 1st ACP / 2nd ACP and 3rd MACP, have been
withdrawn and it has been directed to recover
