discrimination : as only the claimant is required to pay
the advalorem Court fee on the enhanced amount of compensation
whereas the Insurance Company ... file an appeal or
fixed Court fee.
(ii) That prescription of advalorem Court fee without upper
limit is arbitrary.
(iii) That the excessive levy
plaintiffs have been directed to fix the
court fees at the ad valorem rate while allowing the application under Order
7 Rule 11 CPC filed ... executed by their attorney, they were not entitled to fix the ad
valorem court fees.
After hearing counsel for the petitioner, this Court
