opined that he is suffering from Corneal Opacity and Traumatic Cataract of left
eye for which he needs Keratoplasty with Cataract operation, which facility
communication dated
09.02.2015, wherein it is stated that the convict is
having cataract in both the eyes and also pterizium. The
convict wants
prayed to release him on parole leave on the ground of
cataract operation of his mother.
3. I have heard learned Additional Public Prosecutor
Gayatri B. Jadeja submitted that
convict wants to get himself operated for cataract. She further
states that son of the convict and the wife
period of 30 days so
as to get his mother operated for cataract operation. It is
stated that mother is aged 70 years. A judicial ... notice can be
taken of the fact that cataract is not overnight ailment and
there is no paper produced as to what
ground that the applicant
accused has been operated for cataract in the right eyes and
needs to take rest.
3. Taking into consideration the ground
referred to Guru Nanak Eye Centre on 25.04.2015 for
performance of cataract surgery. The petitioner claims that though he was
admitted to the Guru Nanak
ground of sickness of the
applicant, who has to undergo cataract operation.

of temporary bail
enable him to take treatment of his wife for
cataract problem.
3. Considering the facts and circumstances of the case, the
petition is partly allowed
enable her to take care of
her daughter who has undergone cataract surgery and needs
post-operative treatment.
