also, the accused
has not mentioned the cheque number of the cheque leaves
alleged to have been lost ... proper action the said Lakshmana for misusing the
cheque from the cheque book which was lost by him is not
satisfactorily explained by the accused
lost by this
accused/respondent. Accordingly he has given a reply
notice Ex.P.8 to show that he lost the cheque in a hotel ... issued this cheque.
The complainant has produced the said cheque which is at
Ex.P.1 which shows that the cheque was issued in favour
some of them were blank. Taking undue
advantage of the lost cheque book, the complainant
filed the present case. Hence the learned counsel made

28. The another grounds urged
also kept bag containing his cheque
book and the complainant had stolen the cheque book and
blank signed cheque leafs from the service statement ... lost the same. It
is not specifically mentioned in the reply notice that accused
No.2 has lost blank signed cheque leafs including
cheque was
altered from 2000 to 2013 and there is no initial of the
appellant. The respondent clearly admits that, cheque was
lost ... contain 6 signed cheque of SBM. It is relevant
to mention that as per the accused the said cheque was lost
appellant has admitted Ex.P.1 cheque and his signature on
Ex.P.1 cheque. The appellant has lost the cheque in question ... honour the said cheque. In Ex.D.3
also the date on which the cheque was lost by the accused is
not mentioned. There
