This Court in the case of Bhaskar Saikia (supra) considered the earlier judgment of the Hon'ble Supreme Court in the case of Merla Ramanna vs. Nallaparaju [AIR 1956 SC 87] and the case of M.P.Shreevastava v. Ms. Veena, [AIR 1967 SC 1193] and thereupon arrived at the view that an application under Section 47 of the CPC can be filed even after disposal of the execution proceeding if it is found that the execution was made excess than decreed.
