Collector, Jalaun), it was held that the provisions of Order 21, Rr. 84 and 85, C.P.C. are mandatory, and in the event of their non-compliance the execution Court or the officer conducting the sale has no other option but to re-sell the property. The period provided for making the deposit cannot be extended. Where the deposit is not made by the auction purchaser, it is not necessary for the judgment-debtor to file a petition for re-sale of the property, but there is an obligation and a duty cast on the execution Court or the Officer conducting the sale.
