The learned counsel for the petitioner made an endeavour to persuade this Court to distinguish the judgment of the Supreme Court in Steel authority of India (3 supra), in the context of judgment of the Supreme Court in ASIA RESORTS LTD v. USHA BRECO LTD (4 supra). In the latter case, specific reference was made to the former in para 15 of the judgment.
